My Husband�s priority date is Oct 2003 (EB3). My Employer is willing to start for GC in EB2. Can We use my husband�s EB3 Oct 2003 priority date ?

HI,
I am on F-1 visa since Jan 2007. and got started my OPT in August 2009. I have on campus income through out the year in 2009. so how do I file the taxes, n which forms. for tax return 2009.
also I got married to a F-1 student in Jan 2009. She is also having her OPT started in August 2009. She has income only on OPT (from Aug to Dec 2009) so which forms she should also file.
my wife did paid her college fee in Jan 2009. and we have paid the rent through checks on leased apt.
So can she/we ask for deduction of any kind?
also which status we have to fill in. "Married filing jointly/separately".
please reply as soon as possible.

If both of you having 1098 forms from school you can file for Hope-credit (each gets $2500 credit, thats huge amount :) ). You cannot show the Apt. on tax form.

All this big companies as declared will reduce h1b employees in us and will do work remotely - so payroll reduction will be in us and ultimately more loss to us goverment.
if they reduce even 4 out 10 than also 6 people government will get $12k while additional 4 govt. will loose atleast tax and social security other together more than 50k and all the expenses they will do here all those money will go out of the country rather than spending done here, so many side impacts to other industries.

Kudos to Senator Chuck Schumer for raising the profile of a serious issue - discrimination against same-sex partners in US immigration law. Even as several states are enacting marriage equality laws and anti-discrimination laws are moving forward around the US (including here in my home town of Memphis), the antiquated Defense of Marriage Act prevents USCIS from treating these families fairly. You would need to take an updated affidavit of support and you latest tax returns if you have filed for any dependents and they have been called for the interview also. Would be useful for you to take the I-140 approval with you. All your original certificates, including birth and marriage, employment letter, W-2's, medicals if the ones that you submitted have expired, you need to follow the list of documents as per the interview letter. If your spouse has been called for the interview you would need to take joint documents and photographs to show that it is a bona fide marriage.

Hi folks,
My baddest of the bad phases started recently when I lost my wife's birth certificate from India. Worst part is we dont have backup (no photo copies of it).
Anyways, We are waiting in the 485 queue, working on EADs. Question to all folks, do still need birth certificate now for the green card process, as we have already sent the application?
And how bad it is with redtape/corruption in India, to get another birth certificate from my wife's birth hospital, when we try by ourselves (I mean not involving our/her parents), when we visit India next time (maybe for a month)?
Appreciate your responses..

My husband has a pending I-130 visa petition (I am a US citizen, he's Italian, we live in Italy). Can anyone tell me whether he is permitted to enter (and exit, as we are still residents in Italy) the US on holiday (departure 19 dec)?
I have not found any specific details in regard.

I got GC under EB2, I'm planning to start my own business. is there any risk factors if i leave my employer right after getting GC and change the Field of intrest?

You can definetly start any bussiness you want. As per the link below it seems it will be safe to stay with the current employer for atleast 6 months.

3. I have four first author paper and 9 co-author papers. I have 2 more co-author manuscripts in preparation. I have 50 citations for my papers.
4. I have done couple oral presentation and 7 poster presentations at national and international conferences.
5. I am currently working as a Research Associate (job title) for University.
6. I have reviewed 2 articles for a journal.
7. I have received one pre doctoral fellowship award from American Heart Association. Recently got young investigator award from University.
8. I have membership of five professional memberships.
9. I have 8 good letters of recommendation from three countries.
10. My area of research is translational and it is being highly promoted by NIH. This is very high impact area in cardiovascular medicine.
11. Currently in process to apply grant to pharma industry of nearly 100K. I have very good chance of getting this grant.
Already applied for EB2 NIW. My university is ready to apply for me under EB1-B (outstanding researcher). What are my chances of getting approval under EB1-b with above qualifications? If possible please suggest bests ways I can present my application to USCIS. I would really appreciate your response. Thanks.

The current "priority dates" for EB-3 as per USCIS is April-2001. Based on this, When can we expect our "485" to be filed and our EAD to be approved ?
I have a law degree from India (12+3+3) and currently I am pursuing a paralegal program from an ABA approved university. I might loose my job oppurtunities if I don't have a work permit. Is there anyway that I can get a work permit with my pending GC application process, without hampering the GC process ? Can I get a work visa (or EAD) based on my education ?
