What will be my status after i file my I485?
My current I-94 will expire on 16th Sep 2007 (on the day my current visa stamp in my passport expires and my current H1 B is set to expire Mid April 2008).
I am planning to make a trip to Cannda or someplace to get a new I-94 as soon as i get my new passport (i had sent it for renewal on june 2nd). But i am a little worried about my status if i am unable to make the trip.
So my question is what will be my status after 16th sep 2007 (once i file for I485 (first week of July2007) and my I-94 expires on 16th Sep 2007)?
Appreciate any responses ...
After you file 485 you are in AOS so you can file for AP and use that to get back into US. Once in AOS it doesn't matter if your H1B expired or I94 is expired as you will be in status. However to work you will need EAD.
To enter reenter US you should have a H1B visa stamp which is valid or have an AP. If you use your AP you will have to use EAD to continue working. Another option is to get a new H1B stamp based on your current H1B petition which is valid till april 2008.

We do not have one in Ohio either (I even checked Kentucky). What would be the best possible way to get updates so that we can join the initiative?

Greencard and H-1B expenses should be paid by the employer. Anything else is illegal. I am requesting admins to close this thread.
Do you have any reference (a legal text) stating this?

Below is data of PD from last four years for EB2-I - only for Jun, Jul & Aug.
Except July Fiasco , I don't see dates ever moving forward in July VB; but they do move in August VB.
Has anything changed in spillover laws in last 1 year - which will explain this no movement in July but in August?
Jun 06 : 01JAN03 | July 06 : 01JAN03 | August 06 : U ---> No change in July. Aug backward
Jun 07 : 01APR04 | July 07 : C | August 07 : U ---> July Fiasco

What could be different this year compared to previous years are
1) DOS seems to make sure no visas are wasted and so may not want to wait for the last 2 months of the fiscal year.
2) More cases are pre-adjudicated which makes it easier for them to initiate the fall-across/fall-down in July than wait for August.
3) DOS has been good at not retrogressing the the visa dates further back in the last few months. They either stay where they are or move forward. But not back. This indicates that they are paying more attention and not randomly opening up visas. This means they want to issue visas by priority dates which would need proper planning (to make sure nothing gets wasted)
All these above factors may influence them to open up in July than August. Again, these are my gut feel.

For one thing - there would be thousands of applications between 07/19 and 07/28 (mine being one of those :D) and the other is that the USCIS doesnt pre-adjudicate. Since the PD has only moved recently, the processing dates didnt move that rapidly
Yes, There will be thousand of applications, but not all of them will have their PD before June 2006. And that's why processing dates will move forward rapidly. In August 15th report this will be evident.

My H1b is going to expire on April 17th. I had found a new job and they had applied for my H transfer on March 27th. I would like to know
1. How many days is required to get a H1b transfer receipt.
2. What happens if my H1B expires before i get a receipt.
3. Should i go on EAD or continue on H1B. My wife is a green card holder for last 3 years 6 months.

Someone told me that taking color photocopy of PR is illegal just like you cannot take color photocopy of currency. Maybe a B&W copy is an alternative.
Btw, why is this hatred towards someone that just walked out of the queue? Blame the system, not the poor individuals who have also waited like everybody else. Instead of venting out on innocent people, do something constructive to help yourself and others. As a donor, pls post responsibly. Guys, give me red if it is wrong to say that.

I did spoke with Sheila Murthy Lawyers on chances of maintaining GC processing and Consular processing.
My firm is OK with my long Leave of Absence...Only thing that threw spanner in the wheel was comment from Sheila Murthy firm's advise.
Per them, to renew AP and EAD, I need to be phsically back in states and also stay in States for the duration of approval i.e. if it takes 3 months for renewal of AP and EAD, then I need to be in States for that duration.
I asked them what if I can apply 5months in advance, from Outside US and someone can fedex it to me. Max I can come back for few days.
.. Per them this will not work...
What do you guyz say ?

Anyone can throw light into this one. Can we track APs now for NSC.
NSC is receipting late and also their AP documents are mailed very late. Please let us know when we receive our AP document after getting the receipts? for eg. 10 days, 20 days etc..
It will help lot of us who want to make some travel plans.. [some like us are eagerly waiting for past 4 yrs!!!]

You can try calling USCIS and explaining the situation. Make sure to tell them that you are dependent on the EAD for employment so ensure that they do not revoke the existing 1 year EAD while in the process of granting the 2 year EAD (If they do that)

Accepting I-485 without PD current also needs legislation...if you don't know about that already !
Good news could only be this. Accept I-485 and issue EADs. Country limit cannot be removed that quickly. I think a legislation needs to be passed to be in effect. What say??

That seems to make sense, because there is no such a thing like a H1-B transfer as every application is a new one, so you can't really file a new H1-B with no grounds when 485 is denied and you have already used up 6 years. But my friends, but but but, you can always file a Labor with employer B and when its pending more than 1 year, apply for H-1B extension/transfer. Woo hoo...

Babu, thanks for confirming that this stupid rule is in fact true. I always wonder how USCIS gets crafty in making new rules.
It will be easier to just get the stamping done in INDIA. That way, will get stamp till 2010.

by the last updated rule He would have retuned with a valid I-94.
