Hi all,
I have contributed to this site and wanted to raise our profile a little more among the techies of the world. NO insurance company will cover the medical examination for immigration and this is true. Medical cost may vary.

Hello
Whm i transferred my H1B to another company, i missed filing filing for H4.
So she was having I 94 of my old company till Nov 2006.
Whn i changed company agn in Dec 06, thats whn i relised her i 94 expired, we submited I 539 for her xtension. but couldnt get it. she exited the country before 180 days of her expiration and planning to apply for new visa in India.
Did anybody had the same experience. Pls share.

I have an employee who was a student and then got employment authorization. She asked me to begin the process of getting her an H1B; but then we determined that she really wanted a green card. Can I use the LCA I got for her H1B to apply for her I-i40?

I live in GA. My 485 was filed at NSC and was receipted at CSC and transferred back to NSC.
As per the filing instructions, I will have to file EAD at Texas Service Center.
But some folks told me to file at the location where I-485 is pending.
I have the following questions
a> Where should I file my EAD renewal
b> Is it true, paper based EAD renewal does not require finger printing

Here is my situation and looking for any previous experience and suggestion from experts.
I have my EAD valid for 2 years PD 05 EB2. I got a job from another company but vendor says I need to be in his payroll. Job wise everything is good. I want to join him on EAD.
Here are my concerns
1. Should file for AC21 or just keep quite till CIS sends a letter ?

You dont have to be employed by the employer for 180 days. All you need is 485 pending for 180 days. So in the letter you can mention that 485 had been pending for more than 180 days.
The only catch is if USCIS question about your "intention" at the time of filing 485. (Since you didnt work for the company after 485, and now specifically says dont intent to..).
At the time of filing 485 you should have proper intention to join the original employer.
Maybe somebody else who went through similar experience can help u.
AC21 invocation letters typically state that you're using AC21 for switching employment after 180 days. What argument should be used to invoke AC21 in my case?

You must get paid by your H1B employer. Middle or another middle is not valid on the face of the law. You cannot ask any one other than your employer for pay also. If you didn't get your salary, file a complaint agaist your employer with the labor department. Do not mention about any entity other than your employer. You have no right to interfare into company matters.
Recently my employer written a mail saying that he is closing the company and said to look for new employer.Previously i am working through a middle layer.When i found new employer he directly approached main vendor regarding contract.Now i am working without middle layer.Mean while middle layer hold my 45 days pay .The middle layer is not willing to pay.It is almost 8 months.I worked more than 20 months through middle layer.Can i get my money back?The middle man Threatening saying there is contract which you cannot go and it is breach.Can you please advise.

Should be out by at latest the 15th... the bulletins in the past have been released in a range between 5th to 15th of the month.
I think with the Columbus Day holiday recently, they might take an additional day to release.

dont worry about it. As long as you can prove that you have been treated/or under treatment, this will not hold your application. This will increase / slightly delay your initial application , but otherwise u shouldnt have any problems

USCIS might re-start PP for I-140 once they complete receipting 485 applications and EAD, AP approvals for July and August filers..which may take atleast 3 to 4 more months!!

Dealsnet is correct. Your wife should have no problem entering if she has a valid AP.

Why do the senators not do somthing of this sort .Everything seems to come from the House . If the House is so concerned about the helping EB folks . They must act now and first veto the increase in fees for H1B visas and secondly propose amendments to the Nursoing Amendment to help EB applicants .
