There is no 6-year H1B visa. There is only 3-year H1B visa that can be renewed again for a total of 6-years stay on US soil. If you have spent 5 years on US soil and your tourist visa visits add ip to say 5 months, you still have 7 months on your H1B term. Even if you get a new visa it will be only for 7-months validity. Sometimes, USCIS makes a mistake and issues new 3-year visa but that is a gamble. Why not just stay off-US soild for a few months?

I got my first H1-B approval in 2008. I am originally from Mumbai and I have always got my previous visa stamps from the Mumbai consulate.
I paid my visa fees at an HDFC branch in Mumbai in the hope of getting an interview appointment in Mumbai this month. I am flying to India next week and I still do not see any open dates in Mumbai for the month of December. For some reason the VFS webpage displays open dates only at Chennai and Calcutta.
So the question... is it possible for me to visit the consulate in Chennai to get a visa stamp? Do I have to explain why I chose to come to Chennai instead of applying in Mumbai? Are there any other problems for people who choose a different consular district?
A quick survey on the US Consulate General - Chennai website only mentions to select the *most convenient* consular office. Right now I have at least one perfectly valid reason on why I should be granted an interview in Chennai.

True up to some extent. When filing AOS, you still "intent" to join for the exact same employment (including location), as specified in your LC. You are NOT required to take that exact employment "at the time" of filing AOS. What is required "at the time of filing AOS" is to have a legitimate intention to take that exact employment upon GC. By joining for that exact employment from anytime now, will actually help in proving the "legitimacy" of your intention (but not "required").
My LC and I-140 was approved with my ex-employer in CA.Now I have a oppurtunity to join my ex-employer in the east coast. Will I be able to file AOS if I join in a similar role and when my PD becomes current ? The immigration lawyer of my ex-employer told me that I have to join in the same location as my LC was approved to take advantage of AOS as it is location specific. Is it true?

Thanks for your reply. If we visit India and come back to US, then should we use AP or H1B stamping? and also can you confirm whether we should work on 1099 or W2 when EAD is used for part time.

OK. Assume that you decided to take the "better offer" by throwing the previous "better offer" and they trasnfer your H1, before joining them you will surely get another "better offer" in few months, because you are always searching for that, what will you do?
"Career growth is important and you have to catch the opportunities on your way." - I guess you misunderstood this.
I will not encourage this practice at all.

please advise what are my options. I-140 is pending and i have 9th year H1-B expiring Dec 2009. still working for same company. in case I-140 stays pending up to December 2009. what should i do to stay in status.
