Hi,
I have a valid H4 stamping till Sept 2010. I got my H1B approved last year(2009) and COS from H4 to H1 approved. My H1B was effective October 1, 2009. Due to recession, I still have not been able to find a job. Now I want to change my status back to H4.
As I have a valid H4 stamping on my passport, can I travel across the border to Mexico, surrender my H1B I94 and reenter the US with a new H4 I94? Is that possible? Can that be done on the same day? Or should I apply for a COS - Form I539 and get it done here?
Please respond at the earliest.

For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.

"I lost the paystub" is crap. On the flip side what were you doing for the three months waiting for it?
Ask him to print the duplicate from your payroll system....this should not be an issue at all if he is not trying to hide anything.
There is a good chance that the visa officer will ask you to prove your legal status on H1 and you may have to do a lot of explaining about the change in status.
It just seems like something is not right here

My lawyer checked my application type as
"h", and stating "Spouse has an approved I-140"
Since I am filing as dependent. Should it be "b" " my spouse or parent applied for adjustment..."
Does it hurt to choose "h"? Thanks!!

Can multiple people together file mandamus?
how about signing a petition and send it to Ombudusman?
In last conference call when some one asked about illogical order of processing
she asked him to file DHS 2007 with her office.
how about about 100+ people filing same DHS 2007? and tell her , illogical processing order is root of many many problems at USCIS.

why dont you call the head branch in USA, and ask them if you can use this degree for immigration.
Cause I have my MS from NEWPORT and when I asked them if I can ues it for my GC then they told me that it cannot be used for immigration.

Most of these were shot using the new 75-300 DO that Bob let me test out. (Thanks again Bob!) I'm impressed with the lens. I may be adding it to the arsenal as a good travel lens.

H-1B visas are work visas that allow foreign nationals to temporarily work in the United States for a U.S. employer. A U.S. employer may petition a foreign national under the H-1B classification which specifically applies to individuals in a “specialty occupation." A specialty occupation has three requirements. First, an individual must have a bachelor’s degree or higher degree or its equivalent for the particular position. Second, the degree must be common in the industry among similar organizations. Individuals with H-1B visas are allowed to work in the United States for up to six years, but visas are granted in three-year increments. In some cases, the H-1B visas may be extended for more than six years. If the individual is in the United States, a change of status to an H-1B is filed in the United States. If the individual is outside the United States, upon approval of the petition, the individual must apply for an H-1B visa at the U.S. consulate. There are only 65,000 H-1B visas issued per year.
The beginning of the fiscal year for 2010 is October 1, 2009. Employers may begin filing their petitions six months prior to the start date of employment but the individuals cannot start their jobs until October 1.
It is vital for those individuals wishing to work in the United States to begin preparing their H-1B paperwork before the cap is reached. My wife's priority date is current now (Marriage took place before the acceptance of my GC). We have to options - applying for FTJ or I-485 as my wife is in USA currently on a visit visa.
Any suggestions if we can apply for I-485 from here, as that is our preference.

Hi Guys,
A quick one. I have a HIb visa which is expiring on 9th of next month . I have never worked for that employer as things did'nt work out. I am currently in Australia and want to work as a contractor in US. I have already figured out who is going to transfer/sponsor my new H1.
I am pretty sure that my employer would have cancelled my h1 which was allotted to me in 2007 quota.
I have a tourist visa as well and i intend to goto US on that Visa and work out on the transfer of my H1 once i land there.
Can i really do the above or am i getting too optimistic.
Please reply soon as i have to make some really quick decisions.

1. When can i expect my EAD ?
2. Is there any rule that i shud start working within some stipulated time after getting my EAD or i can take my own time ?
1. it should take another week or 10 days...
2. you could start when you want....
my husband concurently file I-140 and I-485 (along with EAD and AP) on 22nd June 2007. We got our I-140 approved on 30th August. I have two questions
