You might want to review section pertaining to determination of processing center in the I-485 Operating Procedures. There is a detailed protocol to determine this, and if they find it to be at wrong center, they transfer it to what they believe it should have been. There may be some ambiguous areas due to changes in jurisdictions by USCIS after your I-140 approval, modified process, or your moving from one state to another. In any case take an Infopass, and ask if you can provide additional information related with your case shuffling between centers. I totlaly agree with this. I am single too with PD DEC 2006. I have been in present job for almost 4 years. I ended up working for a non-profit oragnization on a non-cap H1b, which prevents me from transfering to private companies which need caped h1b( i din't knew about this when I took up the non-profit organization job). The only way for me to get into private company is to get a new H1b under cap which starts from Oct 2008. This time I planned properly and got an H1b approved. But to my shock and surprise EB2 dates moved to June 2006. I am now carefully watching the September EB2 dates. If it gets closer to Dec..I need to pull back the 485 as I don't think I can get marreid within 6 months due to family responsibality back home. If I withdraw my 485 application, I will lose the queue, money and since I plan to change job, the only benift I will be taking with me , is the PD date which I can later transfer if my next empyer does my GC. With a 2.5 year h1b left, I am hoping under worst situation, my next emplyer will sponcer my GC. This whole GC process is a pain in ***...!!!!

dont worry about actual salary being higher than LC salary.
i had the same issue last year...my bonus put my total salary over $50K than what was listed on the LC. i checked with my lawyers and they said that was fine.
Just curious - Have you heard of a case being rejected just because the salary was higher than the original LC ?? (Assuming job title/description are same or similar). I think it will be almost impossible for them to reject just because is higher!! Govt. cannot dictate the upper limit of salaries (in private sector).

If USCIS was a tv company here is what would happen:
A person would purchase the tv and after the warranty expires within 3 years, the person will need to apply for extended warranty at a designated USCIS tv store before he can use the TV again.
Once the owner 'applies' to purchase warranty, the USCIS can choose to hand out a yellow form for further administrative processing, this can take anywhere from 2 weeks to 4 months, within which time , the owner is not allowed to switch on the TV. Once the warranty is approved and purchased, owner will need to repeat this process every other year.

How about the reverse change of status ? A person currently on H1 visa decides to resign from company & wishes to go on H4 (spouse has H1B extension applied for). What is the time frame in which the H4 has to be filed for .... with respect to resignation .... before resigning or after resigning .... is so within how many days of resigning. How does this person know if he/she is in status as H4 approval might take months .... Will the spouse's H1B extension receipt notice be enough as the approval might take a while.

Its weird but found out the reason for LUD change. I had done address change in June 1st week. But didn't get any notice from USCIS. All the hard LUD and wrong message of case transfer was due to the confirmations we got in mail about the address change.
But intrestingly got soft lud on mine and husband's 485 today morning. Don't know what is happening. We have applied for my husband's EAD renewal . But his EAD application had already soft LUD after Finger printing. These LUDS are after almost a week and on 485.

Hello Folks,
I am on H1-B since Aug2009 and last year I transferred around 40K USD to parents. All these transfers were spread over the year in the denominations of 5K per transaction.(As and when I saved money).
My question is, do I have to pay taxes in US on this money transferred to India. I know that my parents don't have to but I am not sure about myself.
Any pointers in this regard will be highly appreciated. Thanks,

Thanks for your reply. My main question is, if I do the H1B transfer (to a company other than the one that filed my labor, 140, 485), who has to submit the application for my spouse's 485 (when the priority date becomes current), my new employer or the old one that originally filed my 485?

Ok, so my PD got current (EB3 India). What next?
1) I dont think I can expect that my PD remains current in the next Visa bulletin as well. The dates might retrogress again...right?
2) When will they open my case for adjudication? Will it happen within the month of March? Will ALL cases eligble to be opened in a particular Visa bulletin month are GURANTEED to be opened atleast to determine the next step (like sending it to namecheck, FP etc ) for that case?
(Dont tell me nothing is GUARANTEED with USCIS :) . I mean to a reasonable levels of the word 'GUARANTEE' ! )
3) What further factors/queues/backlogs determine when a case will be opened for adjudication when the PD is current and I-140 is also already approved & FP done.
4) Namecheck - The new rule of auto-approval/clearance past 180 days.....when does the 180 day count start from?
--- Receipt date of I-485 application OR
--- Date when the application is opened for adjudication following the PD becoming current for that person OR
--- How can one find out what their namecheck status is? If we are past 180 days, is it safe to assume that we are cleared on Namecheck?
5) Will anything at all happen in my case during the remaining of this month Feb? Like pre-adjudication of my case etc in anticipation of my PD becoming current in March (as you can see by my IV handle name....hihgly optimistic :) ) ....

I-140 PP is only available if you are within 60 days of your H-1 capout. So for most people who are porting PD from EB3 to EB2 , there is additional wait of six months to an year just for I-140.
Porting PD from EB3 to EB2 can easily take 1 year including new PERM application, I-140 and I-485 interfile.
