I got RFE through attorney. It is asking following details
1. Emloyment verification letter with present and intended permanent employer
2. Last two months pay slips
3. "Although your I 140 petitioner indicated in your initial I485 filing that you were employed by company A at that time, your Form G325 indicated that you were employed by company B and you were authorized by B at that time, please explain discrepancy"
I am bit worried about question 3. I worked for company A and labor, I140 applied when I was with A.
But during I485 filing I was with company B and in G325 I mentioned that.
It looks like company A by mistake mentioned that I was still with them.
I called my attorney he said its upto me decide which company I should work for.
But I am not sure company A provides an employment letter for me because I am working for comapny B now.
If B provides employment letter since it is >180 days since I 485 applied, will there be any issues?
Please give your opinions...
From what I understand, you changed employers before filing I-485 and used the same Labor/I-140 from the old employer to file I-485 while working for the new employer? Wow!!! And your new attorney filed your I-485? Your attorney should have known better....
From what I know, it doesn't work that way, the 180 day rule applies to change of employment after filing I-485, not before you file it. You should have started a new LC/I-140 with company B and filed I-485 using the PD of the old approved I-140 from company A...But your case is not lost as long as you can provide an offer of employment from company A saying that they will hire you once the GC is approved...
Obviously, this is my opinion and others can comment on this as well....

My wife recieved AP which was approved on 30 Aug. They approved mine on Aug 31. I have not recieved AP yet. My attorney advised to wait for 30 days.

What if you have to leave the job before 180 days, about after 150 days? When I say you have to that means there is no alternative. Employer-Employee issues. Quite a few folks here might be aware of it. But anyway, I read that USCIS will consider 180 days based on the I-485 'Received Date' and I-140 'Revoked date' will be the date USCIS act on the letter they receive from Employer requesting to revoke I-140 not the date employer will send letter to USCIS. I'm aware that there is no specific guidelines of which date USCIS will consider as 'Revoked date', but I heard USCIS mentioned verbally in many conference that they consider I-140 'Revoked date' as when USCIS act on the letter they receive from employer. Any thoughts?
There was a previous case where USCIS denied I-485 based on the cancellation of I-140 as per 'receipt date' of the request, and not on the date USCIS acted on it.

I disagree with waitingnwaiting. I had got 221G about 5 years back. I work for one of the fortune 500 company and had all the paperwork sent by our company's professional law firm. US embassy randomly picks application for processing. It took abt a month to get the approval. As long as the application/documentation is correct and there is nothing to worry.
I would suggest to spend more relaxed time with family or going out which we rarely get with 3-4 weeks vacation.

The USCIS has not taken any official position on whether they would allow the after I-140 3-year extension to be transferred to another employer.
Using this loophole looks like many of us have actually sucessfully tranferred the H1B to a new employer after the 6 year limit..
As long as USCIS does not release any regulations...We can do this ....

I now applied for EAD for my wife (not because she is going to work, just go get SSN). I do plan to get SSN for her and then file amended 2008 return. I wonder if I will get stimulas package then (the one which was given in 2008)?
I amended my tax for 2007 (filed in early 2008), intially filed with my spouse's ITIN, to change my spouse's ITIN with new SSN. IRS did not send any check. They simply replied that people without ITIN are not eligbile, which I knew, and which was the reason of my amended tax filing. Looks like simply changing ITIN to SSN is not treated as a tax amendment.
If changed situation (new SSN, children etc.) allow the check, this year's tax should take care of it as per instructions on IRS website.

This is a very good PDF on USCIS website..AILA has many rights to demand explaination from USCIS...they do ask questions about EAD extension etc...
We should figure out a way by which AILA demands answers from USCIS regarding using the 140K wasted visas because of slow processing...

One approach I can think is to meet officials and explain them to automatically disable the employers from doing so...An approved 140 should not be allowed to cancel, once 485 is filed and 180 days passed. This will stop the wastage of resources and help to improve efficiency for CIS. Is there a chance we can convince this??? more on the side of administrative fix???
How about making an official AC21 form (like we've AR11 for address change)? CIS can charge a small fees to file for AC21, it will guarantee candidates that their AC21 application has reached to CIS.

Why don't we just voluntarily mention the amount that we contributed in our signatures ? Since contributions are voluntary, so should be the option of disclosing information on it. When many contributing members start furnishing their contribtion information voluntarily, it becomes the "fashion" and others will follow suit, as no one wants to look like a free-rider.
As for the veracity of the information, we got to trust each other on that and follow an audit policy- I assume the core members/ administrators have the ability to cross-check the contribution information if someone looks suspicious. Anyone caught furnishing false information can be blacklisted. Such a policy minimises the work of the core team, without being overly intrusive.

Considering that "Have you ever?" has caused several posts, it is clear that such a question about the Bible does make people think. Now, why do people so many react to a question like that? Do they feel guilt? Do they feel satisfaction with their life? Do they have some secret hatred against Catholic Priests ever since they were 7 years old? Do they feel annoyed at all these constant "do they" questions?
How is it that a question about the Bible raises so much feedback, whereas a question like "Have you ever climbed Mount Everest?" would have little or no affect.
Staying on topic, I thought the end was already clear until omnom jumped ahead. :)

Hello friends,
Of late everybody is talking about bad economy. I mean its all over the TV and newspapers. Apparently we are in a recession since past one year (since Dec 2007).
However, odd it may though sound, I don't see any real economic slowdown in IT sector. I mean all my friends and acquaintances in IT industry in the US and India are retaining their jobs. I recently talked to my IT recruiter and she told me that as far as she is concerned this year has been like any other years. Bit sluggish at the year end, but loads of requirements lined up for January next year.
Am I the only one who is feeling this way, or others also sensing the same thing. Maybe the real jolts are still lying in the future, in the coming year. Or may be its just a hoax. I would love to know other people's observation on this strange anomaly between what is being reported in the media, and what is being observed on the ground.

in korea great unhappines and people flocking back to stores due to another d70 problem...blooming. maybe a storm in a teacup, but some reviews also mention it. blooming has nothing to do with lenses or the operator.. it's a hardware problem.

Well if you read the post by ron, someone has already asked him, on what basis do you predict the date and he simply has replied like this,
"I'm basing that date on what I've been told by the Visa Office."
May be he is in constant touch with the folks at USCIS and not DOS. But one thing if you notice, this guy (Ron) has been correct in whatever he says in the past......
I am in EB3 but i am happy that things move forward for atleast EB2 folks because we can get as many people as possible out of the queue..... with hopes that one day eb3 would move forward too :(
