So sad and unfortunate. I'm always surprised with this. USCIS which is supposed to be the expert in approving/denying visa - approves it and some American in Delhi thinks that's wrong without even looking at the packet.
It's just annoying and unfortunate. I hope IV would help.

I was very impressed by the guy who sang the national anthem...who was he?? He was too good!!
And for all of Logiclife's detractors, you should have heard him speak yesterday!:) He is simply 3 good!:) he could have energized you, motivated you and prompted you to do more for our cause, by the way he spoke and what he spoke.
We're still talking about it at home and how good both of us felt to be a part of this movement. Can't wait to see more pix and videos!:)

If you did not file the AC21 paperwork, what triggered the RFE? Was it a new H-1B petition with the new company?
I was amazed when my HR called me today to let me know that they had no problem in signing the letter and immidiately after the call, faxed me the signed letter.

I know that if you don't have H1 stamping you need AP to reenter. But if you have AP why do you need H1 stamping if you are working for the same H1 employer after reentery? Is H1 stamping a backup to AP?
Some people want to maintain H1B even after AP is approved, just so that they can bring their dependents. But its also nice to have AP in case your H1B visa is rejected.

IAF - You mean you files your eb2 case with three year degree?
When did you file? did you labor approved?
could you give me an example, how you changed your role and responsibilities for eb2?
If your eb2 gets denied, hope you have eb3 keep running as it is right?
Did you file your eb2 with same employer who filed your eb3?

I work as independant consultant as aslways have risk of no assignment for shorter term.
This is what i do - see if it helps
- Create emergency fund for 3/6 months if you dont have already one in place.
Atleast 3 months, depends on how much one feel secure / confident to getting another assignment/job in case of job lost
- Open/get approve HELOC -
dont use untill necessary - if any further emergency you can tap that always
- Start paying the mortgage as additional principal some part of your surplus (even $100) every month which helps you get higher limit of HELOC at later date

I do not know when you started the process of renewal, but you could have filled 4 months ago. Then, secondly, if you are so eager go and take an appt in another city. Just an option...Everyone has the right to do whatever they choose...
I know sir every one has right to choose whatever they want but info pass only gives you the answer which in online or when u call them its the same thing. and for your information i have filed my application on june 2nd and still not received anything...and it can cause my job....and when i tried to get info pass it does not allow me another city when i put my zip code and all the dates in the next month are taken..........

It appears that most of the one sided agreeements mentioned above are not legal. For eg if in ur offer letter u have 2 weeks of notice period from your side and company says they can termniate you without any notice period then its not legal.
I think only 2 side agreements are legal and all other agreements even if you sign are not legal.
(pls confirm with ur lawyer ...)

FYI: I got my I-140 approved on 07/06/2007 after 7 months of wait. This just makes me think that while approving I-140 they didnt even looked at my H1B. The processing of these applications are completely separate. Since my I-140 got approved recently, my employer might not have lot of issues with IRS or INS. ??????????? what do you guys think.

Guys,
Getting a residency now is very difficult. Getting a waiver now should not be that hard. I would not say it is easy but if you get a residency position, just take it. We hesitated at first but got through all the issues without any problem.
