He says he is 60 years old today and was a software engineer. There was hardly any software 40 years ago! Plus what about telephone! How many folks had telephone in India 35 years ago!
And a little too melodramatic too. Our lives are not as bad as he portrays it to be!

Increasing of visa number will help every one including who are waiting for I 485. More visa number will make priority date move. How come they are not interested?
Suppose IV decides not to focus on I-485 filing but some other issue. By this analogy, all members with interest in I-485 will leave.

As per AC21 rule, it is from Receipt. However, let's put some practicality into the matter. Some IO's interpret the rule wrongly and used Notice Date instead. So what will happen? Your GC denied for wrong reasons and you file for MTR because it was USCIS mistake. If you're willing to take the chance, then go. If not, better use Notice Date for practicality purposes and to avoid all the hassle of MTR, etc.

i'm just putting my opinion in my way. that's what this forum is for. atleast not talking BS, just staying on the main topic.
btw u answered for ur urself, i'll just repeat with a change "why are you replying to this!" go see a doctor, is my advise.
Sir with High Regard,
My request is that if you are starting something like personal discussion then
Please don't put message which look like something is confirmed like your topic Secret news! Per country limit would be removed.
this sense like something confirmed and people will come and read.
don't feel bad if people are pointing you for something good for everybody.
Thanks with high regard again :)

Hi apatel_17,
my in laws have visited 4 times from past 4 years, i would like to talk to you about my chances/procedures of claiming them as dependants, my email id is vinodkumarn@yahoo.com
please can u email about about how to go about this issue? i have never applied for extensions each time they were here for 6 months.
Hi, I am posting here instead of sending you an email so more people could benefit from this information.
Check if your in-laws pass the substantial presence test - http://www.irs.gov/businesses/small/international/article/0,,id=96352,00.html
If they do, your chances of claiming them should be 100% for any year they pass that test for (if they do not have significant income abroad, and are not claimed by anyone else as dependents in the US. There are more details from IRS on this subject, if they have significant income abroad).
You can amend your taxes going back 3 years. So you can get a refund for earlier years as well.
When your in-laws are in the US, get them to apply for an ITIN
http://www.irs.gov/businesses/small/international/article/0,,id=96696,00.html
http://www.irs.gov/pub/irs-pdf/fw7.pdf
This is somewhat tricky because IRS only issues this at time of tax filing these days, or if the applicant has US income. Go to your local IRS office if you have to, and open a savings bank account for your in-laws, if you need to (I did not need to, for my parents)
Complete the W7, take your in-laws to the local IRS office (with the passport and visa) and file the application and get a receipt.
Wait 6 weeks to get their ITINs (which I am doing right now with my parents' application)
File an amended tax return for previous years, or file the return for a new year claiming them as "exemptions"
Donate a fraction of your refund to IV ;-)

If it was EB2, you have better chance of winning lotto than get EB2 approved with 3 year degree. I had 3yrs + PG Diploma + 6 Years of Indian Experience + 13 Years of US experience and I was never able to cross the labor certification hurdle. BTW, I tried 2 times.
Hello,
My I-140 got denied based on my Education.
I have 3 yrs + PG Diploma which is equivalent to US Degree according to my education evaluation.
Experience:
- 6 yrs of OUTSIDE USA experience
- 5 yrs of USA experience including 2 yrs of experience with current company.
- I am working as FULL time with an American Company at present
The JOB Description for PERM was:
"Bachelors degree in Computer Science plus 5 years experience; 3 year Bachelors degree plus 2 year post-graduate diploma in Software Engineering and 5 years experience acceptable. "
Gurus, please help me providing some info, if there is any chance of getting it approved if I file a Motion.. or what should I do next?
Since it was denied on Aug 4th this month, I have 30 days to reopen this case..
Please advise me..
Thanks in advance..
Regds,
Raju

The Senate's better vision
Published May 26, 2006
.............
The Senate on a 62-36 vote Thursday approved a far better plan.
...................
This issue is too important for such heavy-handed partisanship. If the House fails to compromise to get an immigration law, it will reinforce the broad public impression that this GOP-led Congress can't get anything done.
..................
Against long odds, the Senate has produced a comprehensive immigration bill that looks beyond the House's one-dimensional solution. It deserves to be considered in good faith in conference committee. Building on the lessons of 20 years of failed immigration policy, the Senate bill represents our best chance yet to finally set things right. It's time for negotiation, not noise.

Here is my guess on who will be in Conference from Senate side.
Sen.Specter, Sen.Cornyn, Sen.Kyl, Sen.Sessions, Sen.Brownback, Sen.Graham, Sen.Grassley, Sen.Kennedy, Sen.Durbin, Sen.Feinstein, Sen.Leahy, Sen.Feingold

There were few employers too who attended the rally because they believed in the cause.
I spoke to a French guy, forgot his IV handle, he got his EAD recently, he flew all the way from Miami, he googled up immigration and found IV 2 weeks back, looked at the rally stuff and came and attended the rally.
Hats of to all these people who have respected IV with passion.
His name is Yann ,I hosted him .

Why you think that is not possible?
What do you mean by "new system"?
If you want to wait until approval, file H-1B premium. If you have skills and its "bonafide job", not much risk for H-1B denial. Note, H-1B visa is not for speculative employment.

I posted here some of the total wait time(LCA 7days and H1 15 days) not for aguing whether I have skills or lack of skill. It is true a better skilled person always there than some one.

is it even legal for you to pay for G.C.
by law i think your company should pay for all G.C. related expenses..
correct me if i am wrong
who pays for GC nowadays? people are paying for their own H1B's. count urself lucky if your company is paying for you. most of the cases we are paying and being treated like BS from both lawyer and company in GC matter

Pappu,
I am assuming that you are looking for someone who was "layed" off; not necessarily just the end of their contract??
May be you ought to expand the criteria to also include anyone who has changed their full time job will-fully?

Those giving the interview please make sure that the point that you put across is that though you lost job . could get another one but couldn't take it up/apprehensive about taking it up because of the AC21 uncertainty/GC uncertainty.
(Home owners)
Because of the above reason there is this confusion for the immigrant house owners which is forcing the foreclosure (like the post by alrbertpinto suggests)which wouldn't happen if the GC process was smooth and less time consuming.
If not careful about what should be highlighted and put across in the interview there is a chance of people picking up just three words "immigrants" "jobloss" "foreclosure" and start making unfair/unnecessary accusations like:
' Immigrants are contributing to foreclosures/housing crisis
What are the immigrants that lost jobs doing here when many of the citizens are losing jobs and are not able to find new jobs'
I'm not sure if this post will be any helpful but I just wanted to share these thoughts after reading the posts in this thread.
Thank you.
this point will be useful when finding a person who meets the criteria for the interview - atleast he/she should mention the point mentioned below ..and this has happened to many immigrants (i.e. their houses go to foreclosure as they have to leave the country because of GC delays).
-------
if the person (the one who will give interview) has lost his job and there is a danger that he will go out of status and this may/will cause his house to go to foreclosure.
the reporter can then get more attention by showing how GC delay is contributing to foreclosure crisis ..as more legal immigrants end up leaving their houses etc etc.
----
I am writing this in a hurry but I hope my point is clear ..actually few months back I read a post in IV from a Italian lady who was facing the above issue
