My checks got encashed this friday. Applications were delivered to NSC on July 2nd, later forwarded to TSC. My I140 was approved in TSC.
Man that was good news!!! I am very frustrated for the last few days as no one got with Texas I140's who filed AOS with NSC haven't gotten a receipt. I now see that we will all get the receipts soon!!!!!!!!!!!!! GOOD LUCK TO EVERYONE WAITING!!!!!!!!!!!

Thank you very much for all the advices. I wonder if I do need to take vacation around the early of year 2008 and come back approximately October, 08 due to my H1B expiration in April, 08. I wonder if I still need to be employed full time with my current employer during the whole period that I�ll not be in US. Do I need to get pay during that period? Would part time be enough in order to keep the green card process going? Also, do I need to file any applications with USCIS prior to taking vacation in order to let USCIS know that I�ll be taking vacation and I can use that vacation time outside US to extend my H1B until around October, 08. If I have to file, when should be the best time to file it and what form should I use? I plan to leave around the early of February, 08. Accordingly, I can come back around October, 08 and file the I-797 form for H1B extension if my I-140 is approved by then. Please advise and thank you very much.

Its called a form-letter.
The staff writes those.
They use the same letter and change the name and address of the constituent and copy-paste the generic position on immigration.
That is the reason you are seeing a letter that casts a wide net on immigration issues, like border security, illegals, etc. etc. The staff would send out the same letter to all constituents who are writing for or against immigration or any issue related to immigration.
All lawmakers have staff who repond to communication from constituents and 99% of the time, you get a form-letter response...the one-size-fits-all letter. The audacity of form-letters. ;)

Hi ,
I received RFE on my I-131 application asking for all the I-94's that is being issued to me.
I had been in and out of US many times and there's lot if I-94's involved and I don't anything with me except the latest. What options do I have?... Also couple of times during my earlier trip (initial visits in US), the AIR Line didn't even take the I-94 from my Passport which ultimately I lost.
My Passport has all the entries indicating my Date in and Date out...
Gurus - What do you advise on my case...
Anybody's input are highly appreciated and I know we could somehow get the I-94 copies by requesting USCIS. (That is time consuming)... I have to respond in next five to ten days...
What options do I have?...

Thomachan 72, if you have already submitted a non avialability birth certificate, if you submit a birth certificate then will the immigartion not question as to how do you have a birth certificate now.

I received IRS tax audit check for year 2005 last week. I guess mostly I can defend my audit and I have scheduled an appointment with IRS tax manager for next week
However god forbid if I have to pay penalty on audit,I was wondering this would impact anything on my 485 process. Does it have any impact

Most audits are routine, once you can back up your claims with paper records/receipts you will be OK, but consult with your CPA and be ready to address the points raised.
Unless you have been found to commit criminal fraud, it should not affect your green card petition. Small penalties and the like have no effect. Last year I had to pay a small penalty because I underestimated my taxes deducted during the year.

The approval of h1 will not invalidate H4 visa. The usage of h1 visa invalidates H4 visa.
if you have h1 approved and don't join the company, then your h4 remains intact. Once you join a company on h1, you will fill out i-9 form, which informs the concerend authorities about your status change.
All these are correct. But the main issue is tv25's spouse H1 is denied and the reason is "misrepresentation". So, its a serious charge. And if its on the company's side that put any bogus documentation then he is fine...but if its on his wife's documentation then he ought to be worried cause it may/may not(only an attorney can answer) affects his I-484 case...his credibility is at stake now.
TV25, Ron Gotcher is a good attorney and this is his web site http://www.imminfo.com/...I don't know him personally but, he is an American and he replies to most of the queries in his forum, and with very good explanation. Ask him...that's my suggestion...

Hi,
I self e-filed my EAD application and the Receipt date is 6/7/10. They called for Biometrics which is done.
I got an email saying that they have sent a RFE. Waited for 10 days, still no signs of RFE. When I called USCIS, they asked me to wait for 15 days. When I called after 15 days, they created a Service Request to re-mail the RFE. Now they say, I have to wait for 45 days. When I asked them if they will extend my deadline to reply to the RFE, she said she doesn't know.
Has anyone been in this situation ?
What kind of RFE will they send for an EAD extension.
I sent my 485 receipt and a copy of my EAD when I e-filed.
How many days do they usually give to respond to the RFE ?
Any feedback is appreciated.

Looks like it is the photos. I got the RFE after opening a Service Request and they have asked for photos. Morons. They could have made it clear in the instructions to send photos.
It doesn't happen to everyone. A couple of my friends got the ead without sending the photos. It all depends on who processes your application. If he is an ass, you are in trouble.
So, better send the pictures if you are planning to e-file.

Did she receive a paystub for the sick pay? I mean, did the employer or the third party insurance deduct federal, state taxes for the sick pay?
If yes, then she is entitled to receive a corrected W2 from her ex-employer.
BTW, haven�t heard about receiving sick pay from third party insurance, this is something new.
My wife worked as a full time employee and resigned after the delivery from Oct'08. She was paid the sick pay through a third party insurance and these wages are missing in the W-2. I tried contacting her employer and also wrote emails saying I would complain to IRS if they fail to provide a corrected W2. Today is 02/14 and we still didn't receive a new W2 for the sick pay or a corrected W2.
1) What consequences the employer would have to face if they fail to report correct wages on W2?
2) Does IRS is concerned about missing wages that are 1-2K?
3) Do you think I should complain to IRS?

The point is that to lobby for keeping the spouse out of the "VISA NUMBERS CURRENT" constrain may not be politically hot as it becomes a very compulsive and humanitarian issue. There is expected to be less resistance and public support as its a family issue. Success may be relatively easy and hence its a ponderable issue.
