Any advise/comments?
My wife worked as a full time employee and resigned after the delivery from Oct'08. She was paid the sick pay through a third party insurance and these wages are missing in the W-2. I tried contacting her employer and also wrote emails saying I would complain to IRS if they fail to provide a corrected W2. Today is 02/14 and we still didn't receive a new W2 for the sick pay or a corrected W2.
1) What consequences the employer would have to face if they fail to report correct wages on W2?
2) Does IRS is concerned about missing wages that are 1-2K?
3) Do you think I should complain to IRS?
I am planning to lodge an official complaint on Monday 02/16. I suppose it was a deadline date for all employers to provide W2 or a corrected one.

though I agree there is no grace period however practically USCIS has not been rigid about the dates. MOST of the employers do not inform USCIS about firing of H1b. During dot com bust, USCIS has 'unofficially' said that 15-20 days are good enough (again not as a policy decision but informally). It should be avoided, however it may not be always possible, and having few days gap should not be something on which you make life or death decision.

Is your lawyer frogamn from CA? Did they infom you about Rfe if not how did you get the Rfe mail.

Yes, Many just browse and forget it. If they have a question, they will register and post into the forum. To post a response/question you have to be registered. Those people are taken care of and are members. How ever, its those bunch of people who dont have a specific issue at this time and are just watching over. I feel that any given time 60-70 % of the guest are just watchers (I mean not anti-immi, reporters etc ). If we can entice half of them that gets us going a lot. Registered members will any way login as soon as they are on the website and will not be bothered by popups. The pop up should come only once per session.

I am planning to get my PP renewed at the NY consulate and had a couple of questions and I was hoping someone could shed some light on them.
i) The DC website states that one can *only* apply 6 months before expiration date but the NY website does not? Mine is going to expire in ~8 months. Anyone know if it is 6 mo across all consulates?
You may have to call them up for this info
ii) They have it in big red font that the photograph should be 3.5 cm * 3.5 cm, the US standard PP size is 50 mm * 50 mm .. any ideas where I can get them done in the right dimension?
I did it at home - using my digital camera and photoshop :) . There are tons of places that would click the PP photographs!!
iii) If applied in person do they issue the PP the same evening?
You can't collect it that evening. The will fedex it to you within a week

Non solicitation clause should state a time frame - but otherwise most contracts have them

same story for me, i just moved to different unit in the same apartment. everything remains the same. Same city, same zip code, same employer.. Somehow i believe address change triggered the RFE. Probably the change in the file pushed my file in FIFO and someone looked into it and gave a RFE. Will have to wait till i get the actual letter.
u r kidding right...u got EVL RFE for an apartment change in the same apt complex? or is it just asking you to update the address verification form. Cos, I just now responded to EVL RFE and am planning to change apt inside the same unit. I cannot afford another lump payment to the freakin lawyer one more time..this is just ridiculous..

Just ignore them...If you guys remember we had the same problem with techworkers yahoo group. At a critical time some guys tried to side track and demoralize us. May be they have other interests in their mind :(

I double checked with my attorney , either or AP or EAD usage will change your status, ie H1 is no more valid.

Actually a lot of folks who are beyond 6 years are themselves to blame to some extent. We did not realize that its a long process and the sooner you start the better it is.
Here's the deal. The GC process takes 4 years on average if you are from India/China. Some ppl get it it in 3 years. Some get it in 5 years. The systems is built in a way that it has to take at least 3 years. Back when labor processing used to take 2 years (1yr state + 1yr federal), the rest took 1-2 years. Now labor is really fast and the dates are retrogressed.
So, now it will take 6 months to get labor and then 2+ years of waiting for dates to become current then processing for 1 year. So about 4 years.
Off course some of us got the short end of the stick when cases got shipped to BEC's and labor took 4 instead of 2 years. and then some people are stuck in retrogression after getting out of BEC's. Its all about knowing the entire game before getting into it. I kick myself for not starting the process sooner.
So, your options are 1) Labor subs 2) Go to India and come back as L1 3) Fight the system 4) Do nothing and wait.
