It's hard to believe that US economy will go down if they make some tough rules around H1 B visas or worse cancel H1 B program. I means, we can argue that it might create shortage for skilled works but if US really need some skilled workers, they can get it any time ( Like straight green cards for nurses etc). it�s few trillion dollars economy which won�t go down just because of H1-B visas holders.
It is not that hard to imagine at all.
500K h1b holders having $60K jobs (on average) means $30 billion to the US economy. That is only .002% of US GDP but that is still a *lot* of money.
Remember the Swift meat packing plant raids. They cost Swift $45-50M they claim. That is greater than the wages of the workers rounded up. Probably around double. If IBM started feeling that hurt, they'd be summoning their representatives to their offices.

My 485 was apporved in July 2010 and have not recieved the card yet. I have contacted with couple of Service Request for non-delivery of permanent cards. First reply from USCIS was that my case was waiting for finger printing information from my local USICS was backlogged for appointments. So, I have told to wait for 60 days for either FP notice or physical green card. After 60 days, I have called them and another service request was created and the reply was completely irrelavant as they says my address was updated for my query about non-delivery of GC.
Is there any other escalation request that I can made for deliveriy the GC or the FP notice? whenever I called the USICS are creating the SR and have to wait for answers like above.
I have recieved the 485 approval notices (for both of us) on July itself but waiting for cards now. Are anyone with the same boat ? Or Is the unusual case?

I know of a colleague who lost her father but could not go to perform the last rites because she did not have the H1 stamped and the earliest appointment that any consulate in India was giving her was 4 months away.
She should have tried through the emergency quota/appoinment to get her stamping.. Death in immediate family is a accepted for this and I know a colleague you had to go for India for the very same reason, death in the family and returned back after getting his stamping. Got his appointment through EQ.
The article posted is touching, but out lives are not that bad .. We are far more better and we do have a good life.

There is no such thing as a cooperative employer in this economy. I will give you an example....
While I do agree with some points on how difficult it might be given the economic environment, we do not know OPs employer or OP himself to make a broad generalization. For all that we know, OP might have 10+ years of domain specific knowledge that might make him really valuable to his employer or he might be working for a desi consultant who is happily taking 60% of his biling rate making him very lucrative to his employer. That's why I used the word "cooperative" to refer to the type of employer.
While no doubt, getting PERM approved is difficult at this time, it's not impossible (I have a few close friends who got them approved recently in EB2 though they had to wait a long time for it) and giving it a shot is well worth it if things work out in OPs favor.
PS: And God knows why I got reds for my previous post. Funny!

Noone is forcing them to be ehre - you are saying. And I am saying: nobody should be forcing them out, either. They are ehre because they want to be here and because they want to discuss something with other people who are here - administrative problems or philosohpical issues.
Being here and being a part are two different things, you are either for or against a thing, if you are for eb improvement then be 100% for it - not i m EB2 so i support eb2 or I'm masters so i support masters, such discussions are fruitless and meaningless... we don't need this
'You should trust the organization in what they do' - you are saying. The organization should not be perceived as an abstract, 'know-it-all' deity that we, tiny humans have to blidnly follow. The organization is us collectively and we should not be following it, but leading it or at least taking it somewhere. Sometimes the road is straight and goes forward, sometimes there seem to be multiple roads that need exploring which may or may not coverge again. Sometimes the journey is not continuous and you need to stop, consult a map or a compass and realing yourself. There is nothing wrong with that. There should never be blind trust because that will sooner or later drive us all down the cliffs.
Everyone is intelligent enough to know whats right and whats wrong... if you feel what an organization is doing is wrong then do not associate yourself with it. If you see a cliff ahead then there is a good chance everyone else will see it too if there is one.... but dont start yelling i see a cliff i see a cliff (when there is none) follow me follow me and disperse the group
'If you have ideas talk to the core and discuss with them in person' - that is exactly what we are doing. Throwing around ideas and discussing them amongst ourselves. Sometimes the discussion is easy and disciplined and constructive and sometimes it is hard and confrontational and destructive. I think that if it is too confrontational or too destrcutive that indicates that not all is well within the group - I would refrain from calling it an organization just yet - and the ideas are not mature or ready yet and/or the group is not really cohesive and it is really not one group. Both of which are problems that need to be addressed and dealt with. By stifling discussion and censoring out ideas that you do not like, you are doing a disservice to the entire group because the group has to discover what is the cause of the destructive confrontation otherwise it cannot successfully function and fulfill its objectives.
You are not doing what you think you are... if you have solid ideas call the core, they know a lot more then what we do about how things work when it comes to lobbying. I guess you only have to look at the flower campane to know what organization and unity means, thanks to their efforts USCIS reversed there decision!

The question i've is:
I heard from my Immigration Lawyer that,from November 01, 2008, any person who works in Information Technology (IT) and who has Advanced Degree from USA like Master's is eligible for EB3 Category only and not EB2 category. Please confirm if the above statement is true or not.

Doesn't the recent USCIS Yates memo (the same one that said that H4 time will not be counted against 6 year H1 limit), also say that dependen children will be granted a GC if they were under 21 at the time of filing the petition? They need not necessarily be under 21 at the time the petition is approved...

Truth always hurts. It is not too much talking when I say that people can't afford to contribute 20 bucks to IV. Out of roughly 9000 members, only 200 contributed in the last contribution drive and now you should be able to do the math yourself. That is the fact and it's very troubling that 98% of the members chose to contribute nothing.
If you expect 200 people to find relief for 1 million so called high skilled immigrants present in United States, may be you need to wake up and do some reality check. Just checking IV 50 times a day for an update will not bring any relief, if that's what you are counting on. No wonder we are yet to see any relief whatsoever.

One of ways in which you can make the lawmakers realize the seriousness of the issue of EB relief is by telling them about it in person. They meet tons of other people every day and hear about many issues that are just as important to the others who meet them. So to convince them of the urgency, IMHO, we all must go to their offices and talk to them. That requires you to take some time off from your schedule. Many of us have already met lawmakers. Join your local chapter.
Can we have
1) links and pointers to background material and other things we could study, so that we are on the same page, and can educate ourselves on what to ask lawmakers/public
2) a presentation/paper, so that we have the same, the best, and the most presentable message.
If this already exists, and I just haven't found it yet, I apologize....

Your employer cannot revoke approved I-140 after 180 days of filing of I-485. AC21 portability law clearly says that. Your employer is playing with the lifes of employees. He cannot win any case in this situation. You better look for another employer and move ASAP. Also, you cannot keep PD as it is somebody else's PD. Eventhough you/your can try appealing with no chances of winning, but you/your employer is trying to spoil the life another person who got GC.

The other person used AC21 and got his 485 approved. INS has denied my I140 since a 485 has already been approved and there can be only one GC on one labor. INS says that once the 485 is approved that job ceases to exist.
My company is saying that they have done this in the past and got approvals. They are saying that they applied the I140 substitution long before the 485 approval of the other person.
Now they are saying that they will appeal that the other guy never had the intention of working for the comapany.
Is there any chance for the I140 approval and using the existing labor ? If not will the INS help me keep the Priority Date.
Does anyone have knowledge of such cases (or) know the results of such appeals.

I don't believe it...did you guys even read the original thread? He is asking about being laid off while on EAD while you went on a tangent about H1B status, buying furniture and rental lease!
Also, poorslumdog, who told you that you that "once you are in EAD and got laid off...you lose your status"?
The only person that makes sense on this thread is ramaonline. Javadeveloper, since you've filed your AOS, you'll be in legal status with or without a job. You don't even need to have a job now...GC is for a future job offer. EAD has nothing to do with it. Has it been 180 days since you filed your I-485? If so, your I-140 is safe since your employer loses "control" over it. Because your I-140 is not approved, using AC21 to port is quite risky but this may be your only path.
One last thing, I hope things work out and your employer re-hires you BUT you really have to assume that they won't and plan for you worse. Remember no one cares about your GC more than you...

A few days I called Comcast to disconnect CNN and CNN headlines from my cable. The Comcast representative was surprised as to why I want to cut CNN. She transferred me to her supervisor. The supervisor noted down my complaint and said that he will get back to me in 3 business days. Next day I got a call from Comcast that they will block CNN entirely from my cable. I thanked them as I will not have bigotry coming into my house anymore.
Sanju, I agree with you that it is very hard to listen to bigotry when it is particularly aimed at us. However not listening to it and avoiding it doesn't make it go away. We must know our enemy and always keep track of what they are up to. Arya-Chanakya the great statesman of Chandragupta's court once said "Keep your friends close and enemies closer" This statement is so very true to this day.

I took the pain of driving to NY all the way from Boston to get my passport renewed. I woke up at 3:00AM and stated off at 4:00AM so that I could reach the consulate by 8:00AM. I was told by my friends that I would get it in the evening itself. Unfortunately, I was faced with severe disappointment that they are no longer returning the passports on the same day. The worst part about the Indian consulate in NY is that they didn't update their Website. When I called them several times, non one answers the phone and speaks with courtesy.
After arriving at the consulate, we were made to wait in the cold for atleast an hour until 9:15AM (They open the doors at 9:30AM). They have no mercy for people. Also, the approach they took to call out people was terrible. It was like a fish market. I asked them if would get my passport back on the same day. I didn't get a straight answer until my number was called. I went there and atleast that lady talked to me with respect with a smiling on her face. Atlast I was told that they are not returning the passport on the same day. They asked me to pay 20 extra dollars so that they'd send the passport by Express mail (USPS). She also told me that I can track the passport.
I then drove back to Boston, the same afternoon. After exactly a week, I got the new passport booklet along with my old passport. I am fortunate enough to have all of the details printed accurately.
My strong advise to everyone is to send their passports by mail.

He was very polite and replied all my questions. He even responded to my emails. This was in 2006.
I also suggest Amarnath Gowda(www.gowda.com), even he won;t charge any money for the suggestions to the general questions.
I used Gowda and RK and I was satisfied with both of them.
You should clear most of your questions prior to hire any attorney, then choose them according to to your satisfaction.
