I tried a preliminary hand at mining the FLC databases. Realized though that another factor missing is EB category. Given all the other variables we have, I think we may not gain much from the exercise.

(b) Relief for EB immigrants is totally non-controversial and everybody and his brother will back us.
Both assumptions are dead wrong. If 900 of the biggest companies and universities in america cannot convince congress to make SKIL bill a priority, then you know what a formidable challenge lies ahead of us.
As for EB relief being non-controvesial, I only need give one counter-example : S 1932.
We are all desperate for any relief : I repeat ANY. To think that the core team would be so shortsighted as to only pursue grandiose bills like CIR and not be on the look out for smaller relief measures is naive and severely underestimating their intelligence.

Well, we can keep the org name as IV, and just start a campaign with a better name (with descriptive URLs) without worrying about the overhead of changing registrations, etc.
There are some good points here, "ImmigrationVoice" sounds very broad and comprehensive. Most American's have never even heard of employment based immigration. Furthermore, they don't see what the problem is with H1Bs - they figure, why are you complaining, you are here in the glorious USA, you should be thankfull and happy.
Anyway, some better branding on our part with campaigns can serve the same purpose as a fullblown name change. For example, the campaign could be called: "Competitive Immigration", and it's derivatives. "Innovation America", like CompeteAmerica which has a great name. Also, "Keep America on Top" or KAT, just spewing ideas that come to mind.... and emphasize the need to keep and attract bright minds to America - or else they will compete with us offshore.
So, let's think about hatching campaigns - like a Google AdWord Campaign, for example, and we'll name those campaigns much more purposely and descriptively. And we still get to keep the IV name as the sponsor. Just a thought.

its not that simple. were you here in 2000-2002 also? When the whole company is running into major losses complete department and locations get wiped out. Does not matter how critical a resource you are. If the people at the top decide to scrap the product, the team goes with it. Thats how companies like Nortel, Lucent etc manage to go from employment figures of 100K to 30K in a couple of years...

ive mentioned it in anovr thread but it applies here perhaps even more so...
if u can create a fairly intuitive JavaScript client update tool... will u ever need my sql or ne of that stuff? ( i mean i no its good to hav on ur resume etc but...)
im 17 and have my first "job" or request as its gonna b for free to giv me sum experience.. plus i work for them!! (part time as im in my penultimate year at school with no intentions of goin to uni)
i tell u theyr gonna be the coolest farm on the web!! lol
i thout itd b a good idea to at least get 1 example of wat i can do on the web b4 i start askin ne1 for money... just to let them no im serious uno?

Perhaps your old employer might have withdrawn/ revoked your I 140 and that might have triggered the RFE. Still all they will ask is new EVl with job responsiblities so easy to answer

But only thing is I am working for different employer and I have NOT yet applied AC21. If this RFE is about "employment verification", I am thinking of sending from new employer since my I 485 filed more than 6 months. I hope this is ok. Please correct me if I am wrong.

Thank you very much for the response. I actually want to put 5 years minimum experience though my lawyer said that it is too much. He would recommend either 2 year or 0 year work experience for this position with M.S. degree. Accordingly, we come down to 2 years with M.S. degree. After receiving the audit letter, my lawyer said I should have put 0 year instead of 2 years. I was also told by my lawyer to give him the answer about the following questions:
1. Why does the company require 2 years of work experience?
2. Why does the company require M.S. degree for this position?
3. Why does all skills and programs require for this position?
4. How long it take to obtain those skills and programs?
I’m very confused and have no idea what to answer why the company require M.S. degree since it is the requirement. Have anybody also have the format of the audit letter?
Also, if I have to be outside of the country by taking vacation due to this H1B issue that is going to reach the 6th year, do I have to be employed full time with the company and get pay as well? Thank you very much.

All of of this, writing to the president, congressman/congresswoman are fine, but PLEASE, PLEASE make sure, that the following are adhered to:
(1) Address the President as "Honorable Mr. President", and not "Hello Mr. Obama"
(2) Please please please apply spell check and make sure that your letter/email/fax is grammatically correct. All of us claim to be "best and brightest" and "highly educated", but having seen the composition skills and grammar usage of a lot of us here, on IV, I would higly recommend having another person, who is more competent in the PROPER use of English language, take a look at whatever you write.
(3) It would make sense to send letters (several thousands of them, if possible), to the President, on the same day. Even if a handful of these letters make it to his desk, each with same/similar content, but from different people, he just might notice it enough.

My apologies if this is not the correct thread (but I think it is related).
It has been a month since USCIS received the response to a EVL related RFE issued to me. I verified the receipt date from uscis.gov. Does anyone know how many days it takes (on an average) for them to decide upon such RFE? I am trying to make sure if it is too late and I should request an appointment through infopass.

well - for the antis - the ONLY post they liked seems to be "pack your bags and go home". Lets not try to force ourselves to satisfy them.
Now, when it comes to out of status issues - lot of people do genuinely fall out of status. There is nothing called exploiting the loophole unless someone breaks the laws.
It is obvious that one must not be on bench, or after layoff without a job. There is no room for loopholes.
We have always seen that USCIS does treat every petition for renewal on a case to case basis. Grace period (considerable) has been considered for genuine cases.
Infighting is common - it happens everywhere. People seldom change.
See - IV is not something like a freedom movement or asking for rights for poor or downtrodden - IV is basically a group of immigrants who are skilled and well educated who want to lobby for a change in system and sort issues. Everyone here has their own selfish motive and that's why this infighting among eb2 vs eb3 , MS vs BS, India vs ROW et al......
So lets not worry too much because antis paint all of us together because of actions of some people. If people realize and change - well it is good for all - otherwise - "we cannot make the horse drink water .." you know what I mean

As a community we are here to support fellow would-be immigrants in whatever way possible within the 'legal' framework of the laws applicable. Sometimes a simple -'get your back wages done or go on unpaid vacation' is construed as a wrong advise. It is quite possible that many of people are genuinely mis-informed about their rights or do not recognize they might be out of status.
A lot of people do not make it a point to read the basics on their status and their rights either and apart from being a forum to rally support for the 'cause of legal immigration' this should be a community to educate people of their rights and provide the kind of support we currently do.

My boss recently changed and the work environment is not good anymore (never imagined this would happen), I am in a constant pressure and no job security. It's a shocker in a fulltime state job.
We bought a house last year needless to say that the prices have fallen. We are now in a dazed state as we just realised we don't have any savings, whatever we had, we made bad choices - house, 2 cars (They looked good at that time though) and put about 10% on the house.
We were planning on to invest all our savings in the house as we recently paid off our two cars and no other debts. But after reading some posts here on the housing and investment market. I am not sure if I want to put everything in the house, having my job at risk and no GC yet.
Being a novice in fianancial matters, need advice.
Appreciate your thoughts on this.
Sorry to here the precarious condition you are living in. Try to be good to the person who is causing the pressure, cause most important of all right now is: You need the income. So, fighting with somebody is not a good idea and its going to hurt you, not the other person who is causing the pressure.
If the price of the house has fallen a lot, then its not a good idea to keep paying for the original price of the house. Talk to the bank, and ask what options you have.
Be prepared for the worst case scenario and start saving so that you have some buffer to make payments for at least 6 months, in case you lose your job.
