    There are many possible explanations of why they are willing to make changes to accomodate the illegal immigrants.

    off course its the vote bank politics but I think psycologically nobody is intimidated by ppl who come to US and are happy to do low-skilled work. They don't work in high-skilled or unionized jobs. They are largely employed by restaurant, cab-companies etc. These are jobs citizens really don't care for.

    Whereas the job that H1 workers have... most ppl (in theory) would like to have them. It remains debatable how many native-born americans actually want to take hardcore technical jobs.

    You can do hero worship of your lawyer whoever it is. I will not.
    Ask him/her if he will do advocacy effort for you or sue USCIS since all his clients are struggling in the long wait and spending a lot of money on immigration consultations, fees etc.

    Ask him if he contribute to IV instead?

    Ask him to give you priority instead of your employer who gives him business every year.

    Ask him why AILA is not giving you regular updates through him. As clients of lawyers we should get regular updates and prompt responses. What are they doing about country caps removal, end of retrogression, recapture etc. I mean they are so powerful, so why can't they do it for us so that we no longer need lawyers and save a lot of money? Arn't we all spending thousands of $s on immigration attorneys ? and only few of us pay only $25 and many are free members and get such a good service from IV website. We all hate to pay a single dollar to IV and accuse IV core of asking contributions every time there is a drive but IV still helps us. They need to learn from us.

    Why none of us has the courage to do it, but we have the courage to trash talk IV and blame its core for not working hard enough for our $25.

    Whats your skillset, I can try to get you a project. No offense, but you do seem to have too much time to loose-comment on others and contribute nothing.

    My opinion (may be incorrect):

    You should show your approval notice at the port of entry along withyour passport(visa). The immigration officer should put the date based on your approval notice on your I-94. If he doesn't (make sure you check you I-94 at that time), request him to correct the date. If still he doesn't then last action rule applies as you stated.

    Hey thanks for the reply. I see you mentioned one thing that caught my eye:

    -- They may want to file an AC-21 letter ( stating that they have permanently employed you for this position for this salary yada yada yada ... ) and definitely a G28 to change representation on your cases in case of any RFE and other communication by USCIS.


    company B is offering me a fulltime position with a 3 month introductory period in which they can fire me without having to provide any reason

    - how does this affect my AC-21 application?
    - Is there a period within which they have to file for this application?
    - Obviously i am assuming if they fire me then i will have to ask the next employer (company c in this case) to file for AC-21?
    - Also in this case does any of the 2 companies A and B have the right to revoke to I-140 or just company A?
    - do i need to worry about company B messing with my application in any sort?

    It is not a free service. One year subscription is $495.
    USCIS mentioned about it in every one's denial letter (denied for education), but common people need to pay that amount to see the details. It is not justified, if people don't know what USCIS is referring into. All big lawyers have its subscription. So they guide their clients in a proper way. OP's lawyer screwed him to file in EB2. Even EB3 also difficult, if the advt. is for a US equivalent degree requirement. May be put advt. for a associate degree or non-degree positions with some college studies. For EB3 candidates did not require a degree, if the position advt. says so. But prepare for a tons of applications for that position.

    TWO MORONS GAVE ME RED FOR MY POST. I AM GIVING SOME ADVICE TO HELP THE COMMUNITY HERE. I HAVE GOT MY GC MORE THAN 2 YEARS AGO. MOST PROPLE DIDN'T VISIT IV AFTER THEIR GC. I AM HERE TO GIVE MY AND MY FRIEND'S EXPERIENCE, LEARNED IN A HARD WAY. I DIDN'T GAIN ANYTHING FROM HERE.

    Would 3 yrs bachelors and 3 yrs masters (MCA) with 10 + yrs of experience qualify for EB2? Is there anyway we can check in that EDGE database?

    Hello I'm from Greece.
    I noticed the mentioned problem these days and I'm fully frustrated!
    You can't imagine my dissapointment when I saw the pictures of a wedding in 20x30cm prints having flares and out-of-focus areas spread around.
    The problem is this:
    No matter the lens, no matter the focal length, the d70 produces an uneven focus area. A focused area in the middle of image, is out of focus in the edges. The focused objects near the edges are far behind. The problem is more obvious in the right edge, especially the lower half.
    I made some simple tests and unhappily this was true.
    I own this camera for the past 3months.
    I wonder what the nikon people could do about that.
    I 'm not happy to lose the camera for the next 3months... in order to send it to the service

    Also I contribute $100 a month and don't get any money from IV. We are all volunteers.

    We are all immigrants working on a campaign.
    I see that the ones who don't want to do any work start complaining and blame every one else who is contributing. And you want to attack IV and donors!

    Of course no one is forcing you to donate, you can just go around complaining, accusing and attacking everyone for the next 10 years instead.

    Once you have started using EAD your H4 status is invalid. There is no process to notify this to USCIS. So, USCIS would not know when you changed from H4 to EAD. However, if they audit your case, they can easily find out about it....that's a different story.

    I don't understand why you want to enter on H4 status and work on EAD as soon as you enter US...thereby invalidating the H4, since you are not complying with h4 status.

    You work for Govt on H1b. Payment would not be an issue. The only issue could be experince certificate. They might ask you to provide experience certificates.

    NSC is really crazy about RFE. They complan about resource and they have time to issue RFE. 99% RFE's are cleared on first response.

    I have a medical RFE. RFE asks me to go back to the original Civil Surgeon. Since I have moved to different place going to same civil surgeon is not an option.
    Has any one run into similar situation. If so please share your experience.

    The realistic answer is no. It is almost impossible to get eb2 in software jobs. On an average it is taking more 9 months to get labor clearence that too if it is eb3. if you are trying eb2 that is almost a definite audit. We have a case in our company which was stuck in audit (eb2) for more than an year now. our company and attorney have a policy that they are no longer filing eb2 (offcourse it is a different matter than they are no longer filing any green card application because of layoffs). So unless you are working for a desi "con"sultant company not many american companies (almosy none) are filing eb3 green card perm applications leave alone eb3 to eb2 conversions. Even desi companies are scared shit because USCIS is knocking the living daylights out of them. Even desi companies are scared of filing eb3 green card perm applications leave alone eb2.

    we are living in a different age now where there are reports that USCIS is sending out invistigators to look into even ac21 cases. Enforcement has gone up, hint :last year h1 got filled on day 1, we are almost 6 months since h1 opened and only 45k h1 have been filled, the reason is USCIS is giving all sorts of rfe, so nobody is filing for h1. Forget about porting as in this environment you will not even find somebody doing eb3, only day dreamers will think of some company willing to file eb2 in software.

    My wife has more than 5 years of US experience and we cant even get her employer to file Eb3 because they are saying they are getting tons of resumes in response to advertisement and they dont want to do any green cards for atleast an year.

    As slim a chance as it is, visa recapture or some administrative fix like a temporary green card or relaxation of ac21 regulations like same semilar job restrictions is our best bet.


    Hi All,

    I am on H1B from 1998, 12th year and counting.

    I applied for my labour 2 times but unfortunately because of different reasons those labor processings could not continue. 3rd time I could use a substitute labor (priority date Oct 2003) which is an EB3 labor certificate in 2005. I applied for I-140 and got approved in 2005.

    I applied for I-485 in July 2007 when USCIS opened the gates. My 485 is pending. I got EAD. I am still continuing my H1B status with my new employer.

    I am not working for the company that processed my GC. Recently I got an RFE like everyone else about my current employment and responded with the support of my current employer.

    I think that the dates for EB3 will not move any further in any near future.
    My question is, can I in any way convert my case from EB3 to EB2. If yes, what would be the process.

    Please advice.

    Nothing will happens to Mr Raju in India. He will go upto Supream Court (it takes 100 years to get justice ever in murder case in Indian legal system). He will die the age of 100 on bail. :D He will not go to jail like Mr Skilling. our india is different. With Money and Political connection, anything possible in our great INDIA. :)

    I am sorry for employees.. Hope company will survive and they will be spared..

    I have been hoping for EAD at least and I can happly wait for 2-3 years for my GC

    if the dates are current I and my fellow non EAD holders at least can file for EAD...


    If not current, they should allow to apply for 485 for the ones that they are at least 1 year far away from the current cutoff date if not 2 years (as per current bulletin, they should allow to file 485 up to October 2006 priority date), this way USCIS can borrow some time to pre adjudicate the cases, also easy for them to approve the cases once they are current.

    USCIS talked about 2 step process (1) Registration and (2) Adjustment of the case by taking out the concurrent process, this was supposed to come in place last December, but postponed to this June, even we are in July, no news yet on this.........if this process comes up in place, every one can file for final stage as soon as they are clear with 140, not sure whether they will give EAD or not? Any body has updated info on the 2 step process?

    Is it adequate if we know the case number? I was able to dig out my case number from there.

    A few question related to the database:

    1) Is the received date the same as the date the labor was filed (in other words, the priority date)
    2) The 2005 and after database structure does not have employee name, and there are multiple records found on "prioirty" date, is there any other field that can be verified from other documents like the case number etc? How to nail down to exact record for me?
    3) Is the SOC code the same as what we should be looking for "same or similar" job?
    4) Assuming answer to above Q is yes, from where can we find detailed job duties for these codes?

    Thanks cool_desi_gc, this is a very good tool provided we know how to correctly interpret the data.
