We have many in our company went back to India after applying 485 or with pending labor, their GC process still in progress
but they choose to goto India mainly becuase of uncertain GC process
I myself have a good offer from my company which I am pondering on, I am stuck here for a while to finish my masters
if I go back to India, it could be that I might taking many more jobs, as I need to train and build a team in India and replace my team here
oh well, I am sure there are stories similar to this we got to find it, we need to show losing one skilled labor could also mean losing many more

Her visa stamp was expiring on 15Feb07 and she entered US in Dec'06 and she was carrying the extended H4 I-797 valid till 2009. The officer at POE gave the I-94 valid only till 15Feb07. I did lot of research and found the last action on I-94 invalidates the previous ones. So her I-94 was valid only till 15Feb07. I went to the local CBP office and the officer understood what I'm talking about. He took copy of I-94 and issued a new I-94. He faxed it to some company which keeps the I-94 database.
So if possible it's better to go in person and explain. My 2 cents.

1) My old Visa(stamped on my passport) was from Oct 1 2005 - Oct 1 2008.
2) In 04/07, I moved to a new employer. New I797(and its corresponding I-94) is from 04/2007 - 04/2010.
3) Travelled outside US. Before returning, I didn't stamp a new Visa because my old Visa was still good. When returned in Jan 2008, at the POE , the officer issued a new I-94 and stamped the expiry date as Oct 1 2008. He mentioned that since the old visa was expiring on 2008 and because I didn't have a new Visa stamped (even though I had a new 797A) , he can't stamp the I-94 with the '2010' expiration date.
4) My attorney just raised a red flag. He mentioned that the 'last action rule' goes against me. The last
action in this case was 'issuance of a new I-94'. So, the best approach is to get it corrected at the
local CBP - Deferred Inspections Office. He is working on getting some paper work ready.
However, another way to get by this issue would have been to file for a H1-B renewal before my
new I-94(the one issued at the POE) expired.
My attorney explained that according to the new immigration laws, the CBP officer should have stamped the expiration date from the 'LATEST' 797A. Most of the times, the officer will just detach your
I-94 from the latest 797-A and stamp it. This way no one(foreign national + Customs) needs to maintain multiple I-94's. However, not all officers are updated with the current immigration laws and policies. Now I'm waiting for some response from the CBP. I will update this thread once I get some positive feedback.

Thanks for your help. I will try and see if they can issue a BC with my mother's name. I am not sure whether they can accomodate that in their fixed format, but its worth a try!
In your case, you have the birth certificate, so you don't need to submit the non-availability certificate. It is better you contact your municipal office and apply for your birth certificate with your mother's name included.

IV has been doing a great job, we should all be proud of being a part of it.

I think we should keep fighting till our goal is met. Can IV core team shed some light whether recapturing the unused visa numbers is ever possible ? Even if there is slightest change, we should NOT GIVE UP and work towards it. I've read that USCIS have so far wasted upto 600,000 EB visa numbers.
Now we are seeing some light at the end of the tunnel for multi year EAD or EAD validity during the period of AOS(I-485). Should we roll up our sleeves and work for the recapture of unused visa numbers ? How to make this happen, Please share your thoughts and ideas.

I have a big hunch that CIR is some how related for making the dates current. This may be a shrewed strategy to keep the legal immigrants quiet and then proceed to "illegal" game.
It may quiet happen that even with 485 filled we get our green card applications revoked due a backdoor ammendment by Grassley.

Guys dont get trapped. Since USCIS is exposed now and forced to accept 1 million application for AOS, these things are coming up. USCIS and DHS are the pets of US Govt. Govt wont let them down under any circumstances.
Now that USCIS and DHS realized the moster coming on their head down the line in the name of GC / EAD / AP and they have maintained the lie with dis-honesty all these years that they could not process 485s because of the lack of resource, they have fallen flat on US Congress to bail them out. Whatever solutions they have had in their disposal all these years they are taking them out and discussing with congress. If they wanted to be really helpful to the highly skilled immigrants, they should have done this long back. All these days they all were anti-immigrants and the ex-director of USCIS was a active member of anti-immigrant community.
You dont have to do anything. Just sit and watch the fun with USCIS. They will come up with solutions and get it passed with congress and they know better than any one else that they are in trouble without solutions. Lots of LAWSUITS will follow in next few months if they dont do their job on time.

The aim of participation on these talk shows is two fold- One to increase the awareness amongst the general masses regarding the problems being faced by legals as the masses are mostly ignorant about out situation. Secondly, for people who are waiting for their GC's and could be potentail members of Immigration Voice for them to join the organization. It has been proven time and again that there is strength in numbers and also the organization needs resources from it's members.
It is a logistical challange to put a program like this together with the host and the panel and IV did a good job at it with knowledgebile authorities like Stuart coming out strongly supporting our cause. Every one felt that the moderation could have been better. It is the skill of Larry King or Neil Conan of NPR that sets them apart but some times there are moderators who are very knowledgible, not necessarily on every issue but are challenged becuase of their heavy accent and other reasons.
One of the posts questioned about the publicity stunt of having a senator on the program. Its not a legal loophole. Some states just do it that way. Their under pinning argument is that you are on a temporary visa and does not have permanent residency. Also, its not the University that makes up the rules. There is some thing called domicile office in most schools and they determine residency for in state/out of state purposes. The domicile office has specific set of instructions on how they should determine eligibility requirements for in state. For example common wealth of VA has state council for higher education (http://www.schev.edu/Students/VAdomicileguidelines.asp?from=students) that provides these guidelines. Check out what AZ has to say and if they say only permanent residency is a requirement to be eligible for in state, there is nothing much you can do.
Also, its not a federal violation as states decide what they want to do with their university systems. If you want you can write to your state senators and assembly man and see what they have to say. Its very difficult to explain them these nuances when there are a bunch of people crying out loud that many illegals are getting in state rates.
