the word "returning worker" makes more sense to me and its the right word to express who you are in two words- rather than story telling.

least $20,000 per visa, the US Attorney's Office said.
Mahendrakumar "Mack" Patel, 55, Rakesh Patel, 36, Alberto Pena, 38, Bernardo Pena, 38, and Marte Othon Villar Sr, 48, encouraged and induced the illegal immigration of Indian nationals in exchange for tens of thousands of dollars per visa, a statement from the US Attorney's Office said yesterday.

The brothers also knew that the visa-seekers did not intend to return to India when their 10-month visas expired, a statement said.

well..I have been waiting for my labor certifcation to get certfied for too long. just after Sep 11 I applied both for US GC and Canadian PR. My wife also applied for her GC. meanwhile her GC moved to regional when suddenly DOL thought it was time to regroup and there it went into BPC. In the meantime we got canadian PR some 2 years ago but we did not move thinking that we have jobs here.Then she got pregnant and lot of complications ( premature labor) and during those complications her company got acquired by another bigger firm who thought they don't need her..and result was job loss plus GC into the trash....meanwhile my labor certification even after 5 years was still sleeping in EB3 category(PD Oct, 2001) when i still have Masters( god knows why my lawyer put into that category)..Now my canadian PR was set to expire in march, 2007..so I thought i should decide fast..and i applied for jobs..and I got offer in vancouver with moving expenses paid from califronia..It has been the toughest decision because my employer is Indian here in california..and I have had good growth(10% average) but not the way I had wanted..I guess he also exploits..Indian exploiting another Indian..because they know I am not going anywhere..plus we work hard.. I asked him to match what was being offered in vancouver..and he started converting CAD into USD..well..it is not fair..So I have decided to heck with US and the Employer..and move on...at least I can come back..it is not an easy move because my son being premature child had lot of free facilities in california..hopefully he will get the same in Vancouver until he gets to 3 years ..and then it stops..

I wish things could work out for you in US. It is sad and there are thousands of people like you with badly affected personal lives due to the broken immigration system. A lot of my motivation to work for IV also comes from coming across people like you and thus feel strongly to do something to solve problems affecting each one of us in the IV community we have all built. Hi All,
Could someone provide some guidance regarding my situation:
1. Currently on 6th year H1-B valid till Mar, 2008, with visa stamped in Mumbai Feb 2005.
2. Have applied for I-485, AP, EAD on June 25, 2007 as dependent on spouse's employment based GC (India, EB3, , priority date Jan 2003). Got EAD, have FP done.
3. The last time I came back from India in Feb 05 after visa stamping, I-94 was stamped with expiry date of 12/26/06 since passport was expiring then. Officer said I could go to local USCIS office and get new I-94 when I get passport renewed.
4. Went to local office with new passport, and officer says they cannot issue new I-94, and that I-94 at bottom of H1 is the valid one, no issues.
Finally coming to the main issue -> Recently got a new job and company wants to transfer H1, but says cannot apply for H1 transfer until I get a corrected I-94 from the airport I entered from.
Anyone with similar experiences, or knowledge of how to get a corrected I-94 ?
Also, any implications of my situation on the I-485 process ?

The easiest option is to travel outside the country and come back and get a new I-94. You might want tot go back to the local office where you went earlier, they might not issue a new I-94, but will be able to correct the date on the issued I-94, after you explain them the situation. A similar thibg happened to my wife on H4 few years ago. We went to the local office (Boston) and got it fixed.

"invoke AC21 without waiting for six months" - I completely agree , that is a great idea if IV feels it is not asking for too much in one bill.
I think its good idea to try to add just one demand i.e. I-485 filing provision without current priority date into Supplemental resolution bill. But I think it will be really nice to try to get ability to change employer without waiting for six months(after filing 485) into the bill also. So that person can invoke AC21 without waiting for six months. I think both of these provisions go hand in hand.
Does anybody know when the next session is starting and when are they going to start discussing this bill and when will we be able to find out if our provisions are there or not?

Employer not paying salary after bloodsucking 7+ years, Lawyers not answering phonecalls, Employer not signing documents, H1-B 8th year expiring. Why O God Whyyyy?!?
I want to do something, but feel like my hands are tied & me thrown into the sea with sharks, with an anchor at my feet. I am not Criss Angel Houdini. My God Allah Zeus somebody help. Oh Well, Atleast I am Senior Member now.

If they do that assuming 500K people apply for premium they can generate over 2.5billion dollars. Add to that all the investment this 500K people will make once they get their GC. Like buyin houses and makin other investments. All this should be brought in front of people so that they see there is a big advantage for them in us getting GC's

Are you planning to get it stamped when you are outside US?
I just talked to my attorney and he says that the US Embassy will club both the 797 dates and give you a combined visa. I still would like to confirm it with other sources as it sounds too good to be true.
I-94 on current I797 expires 4/30/2007
Am expecting H1B approval 4/30/2007-4/30/2010 soon.
Plan to travel in February 2007.
One thing I noticed is my previous visa stamps only had a end date but no start date. So I am guessing/hoping the start date is effectively dictated by I797 (which I will have 2 of).

I hope people dont have the issues that happened to two ppl I know. One is my bro-in-law, a first time applicant whose H-1B issuance fee was accepted but his visa has not been stamped. It has been pending March, 2006. Another good friend of mine went to chennai for restamping (He had lived in SFO for about 4 years) for his 2nd 3-year H-1B and he too has been stuck with some name check process since april of 2006. The chennai embassy maintains some website with the list of names of ppl with pending issues and his name has been there for 10 months now. I am not trying to open a can of worms here but both of these ppl are muslims with common muslim names. I am sitting here in US hoping to figure out some way to not getting in the same thing. I have been here for 10 years and this is a lousy feeling. But I hope the nightmare these two ppl are going thru does not happen to anyone else.
