This is a news RK charging for suggestions.
I spoke to him couple of times prior to becoming his client and he never charged me anything.
He was very polite and replied all my questions. He even responded to my emails. This was in 2006.
I also suggest Amarnath Gowda(www.gowda.com), even he won;t charge any money for the suggestions to the general questions.
I used Gowda and RK and I was satisfied with both of them.
You should clear most of your questions prior to hire any attorney, then choose them according to to your satisfaction.

At what point of GC process you don't need your lawyer anymore? Is it true that after filing I-485, and if everything is smooth with ur case, you don't need lawyer. It's hard to answer. I still have a lawyer and all correspondence is going to lawyer. You never know how tough RFE/NOF could be. But I file EAD and AP myself without lawyer.

My sympathies with your situation. If u can't go to India can't u use a service like mymaninindia.com to get you marriage certificate?
Also the best person to consult would be your lawyer as to whether u might get an extension to file your reply.
Sorry layman answer hope it helps

Based on the response to the rallies and the funds drive there are very few contributing memebers .Shall we restict the site for a one time registartion fee .So that people wont create memberIds on the fly ?
A token amount of 20 bucks one time registartion works good
Today If I look around this is the most useful site for legal immigants. I think one time fee of 20 bucks is a very good idea.

Are the sample affadavits floating around the ones to be used (that my parents can fill in and sign) and would that be sufficient. Does it have to be notariazed or parents filling/signing it is sufficient.
Also do consulates of India etc provide such affadavits/birth certificates?
confused...
it has to be 2 affadavits....right...one by parents (both parents on one i'm assuming) and the other say an uncle (is there a format for that one)...
You need 2 affidavits, one from each parent. Or from one parent and one close relative. Or two from two close relatives. They do not need to be notarized as long as they are self-attested. Scanned copies are fine. Retain the original with you in case the CIS asks for it.

You are absolutely right. Its almost as if democrats are wishing that CIR will go away. As I said in my previous post last time we had, Arlon Specter, Bill Frist and President Bush pushing CIR to the top of the agenda, the senate literaly set aside all buisness in May to get CIR done. This time CIR is like an untouchable disease nobody wants to touch even with a ten foot pole. Maybe something is happenning behind the scenes, we can only hope something is happenning behind the scenes.
In addition to the bills you listed below, you also need to consider the time lost in the dreaded confrence between the house and senate when the bills are reconciled. For example the minimum wage increase bill passed by senate comes with some tax breaks wheras the minimum wage increase bill from house does not have any tax breaks. They have to have a confrence to resolve the differences between the bills and revote on it.
The bottom line is CIR will happen if there is strong will of the congress. Right now you dont see any. Infact congress wants to look the other way when it comes to CIR. They have enough execuses to not do nothing on cir with there preoccupation with Iraq war, the 9 bills listed below etc. Unlike last time no strong man (rather men) is Shepherding it. So best case scenario might be December or Jan 2008.
As some wise man said "patience is a virtue" and we need tons of it if we were to live to see the day CIR passes :D
Let’s see, Senate has so far passed Bill #2
And here are some of the bills in numerical order in which they were listed in Senate
3. Stem Cell Research Enhancement Act of 2007
4. Medicare Prescription Drug Price Negotiation Act of 2007
5. College Student Relief Act of 2007
6. CLEAN Energy Act of 2007
7. College Opportunity Act of 2007
8. Rebuilding America's Military Act of 2007
9. Comprehensive Immigration Reform Act of 2007
Also on an average it takes about 10 Business days to debate and vote on bill.
Lookup at the senate calendar (working days week offs etc)
Lets assume (when have things gone right for us?) everything goes according to the order listed above. We have 80 days of work before CIR comes to senate.
Considering that senate takes weeks off (first from Feb 19-23, second from April 2-9). I don’t see how they can start CIR before May at the latest.
Now they might say some of the bills could be a days worth of work, or not necessary bills will be taken up in numerical order etc.
But I ask you again. When was the last time we were lucky?

Everybody should use this template to e-mail the reporters and Senators. Its point blank and thought provoking.
I exactly did that, sent this in an email to senators my state.
Subject: How can I become illegal?. I am tired of being legal.

Why do they get the FP and Medical if they are going to expire. Why not when they are ready to give the GC. That way they can save time and money for millions of applicants. I guess that is what they do not want to do.
Technically speaking, you send your I-485 when they are "ready", which means, your dates are Current, you are eligible for a visa. Beyond that point it is supposed to be a short administrative delay, which unfortunately is extending to years...

Didn't understand you specifically mentioning "US Stem Graduate" in your signature. What do you want to convey through this statement. Ofcourse other statements looks OK.
I think what is being conveyed is NOT that he is superior .... but that he has been in the US atleast 2 yrs more than when he actually started the journey towards GC by formally putting in an application

Employment Based Green Card - Q1: Is H4 only valid for children under 21. What happens to children who have been here for long on H4 status and turn 21?
Q2: If the answer to the first part of Q1 is YES, will the approved I140 (that included the dependent H4) be valid?
Q1: Yes
Q2: I-140 does not include any dependents. Without visa availability Child protection act does not work.

There's a EB3 140 approval drought in not just NSC, but TSC too. I think it's going to get worse with EB3 becoming U. I am myself EB3 Mar 2005 and my job isn't looking very stable after my company resorted to outsourcing.
Can we suggest to AILA reinstatement of premium processing for those who've waited beyond some acceptable period of time? The same way they are doing for people whose H1's are at the brink of expiration.
I don't see any other way they will ever give heed to this problem i.e. where no monetary gains are involved.

there remains a sliver of hope- its called the lame duck session when a lot of such measures are passed. post election, everyone feels "safer".
a marked up bill, ready for the house, could sneak through in the post election season. we have to keep trying!
Thanks Paskal!
This is exactly the kind of communication we need from the core.

I wonder on what basis did they advance the dates by whatever margin they did. No doubt, any positive movement (in hours, days ) is good but the consolidated database is not in place as I understand and so this seems pretty much a watershed. The dates might move with out any GC being issued :)

I never had original or any kind of birth certificate nor have it now , As part of GC application I have provided a certificate issued to me by Indian embassy in 2004 stating birth date, location with passport number as reference. Not sure if any Indian consulate in USA are providing that anymore.
I see lot of posts about birth certificate, I sure thought I would have to go through that process but I was never asked to provide anything more than what I have provided to USCIS. May be the rules are different now or it depends on case to case.
We should not be going through that painful process of chasing people in India to get birth certificate. I strongly feel that Indian embassy should provide it. It could be one of things that would generate some income and add value to the services Indian embassy provide.
Can you please help me with this?...I have already submitted the affidavit copy and now they want it from Registrar office. Has any one got it from registrar office in India? if so, how difficult it is and what is the procedure?
"A photocopy of a birth certificate issued by the Local Registrar if the person named above was born in a city, or
A photocopy of a birth certificate issued by the Additional District Registrar’s office if the person named above was born in a village.
If a birth certificate does not list the names of both mother and father, or the child, secondary evidence must be submitted to establish parentage. Secondary evidence includes, but is not limited to , copies of: medical records, school records, census records, government-issues identity cards, religious records and/or affidavits from at least TWO persons alive at the time of birth. The oldest available evidence that lists the names of both parents should be submitted."
Thank you!

Yes guys take this route .... Another workaround i used for getting H1B extension approval paper... I told Desi employer that my state requires H1 797 form to change the Drivers License... Lot of states do need that so i used that to get that.
You have to be tactical while dealing with Desi Employers !!
Curios, is your employer desi. Wait for sometime, tell him that you need to go to your home country and need receipt notice to use your AP in return. Catch is you have to use your EAD & AP after return.

I know a person who applied TIN number for their parents as they stayed in US for more than 180 days(that is technically possible as some months have 31 days, so if you correctly plan your paretns trip, people on visitor visa will be allowed to stay for 6 month or 183 days) . Also ff you talk to your immigration officer at the port of entry and convince him that an extra three days would be helpful for parents, he might give you 183 days visa.
You need to prove the substantial presence of parents in US.They have a formula to calculate that (total number of days present in current year + 1/2 of number of days in previous year + 1/3 of the a year before previous year) and it that total is greater than 180 days + some other technicalities(which are easy to prove), you can file for TIN number and file taxes showing them as dependents.
