Just got my license renew in CO. Besides CO complying with the Real ID Act, Mr. Owens the governor call a special session to pass legislation to require people to be cleared (legally can be here) in order to get benefits. So before you get your DL, you need to be clear by going through the Systematic Alien Verification for Entitlements (SAVE) program (http://www.uscis.gov/graphics/services/SAVE.htm). Basically another federal database that is expose to local govt. If they SAVE doesn't respond with clearance right away, then you need to provide documentation of why you have lawful presence in the US and give the DMV a stamped legal size envelope so DMV can mail out to Homeland Security. I didn't clear at first but since the DMV initiated the search and told Homeland Security that they will be mailing documents in, Homeland Security actually did some more checks just to avoid more paperwork. I got clearance 1.5hrs after the initial query. My wife got clearance on the spot. There was a fellow before me that was trying to find out why he and his wife still haven't cleared. Its been 3 weeks and of course his license is expired. For those on the 1 yr renewal of h1b and waiting for their gc, they have to renew their license every yr. That means we need to pay the renewal fee every yr. I know this isn't really a Head Tax but in reality, as a legal immigrant, I'm paying more than the regular permanent resident and american citizen to get a DL. Also the politicians just don't think things out clearly. The right DL should not be use as main identification. The original purpose of a DL is to show proof that you're competent, have been tested on your ability to drive and understand the rules of the road. They're not just hurting legal immigrants, they're hurting their own American citizens (children born to legal immigrants). These children won't get the freedom to move about, etc. PS, the SAVE program even affect American Citizens. If somehow 20 yrs ago, someone makes a typo, the DMV won't find you so you would have to go through the SAVE program to get cleared.

If you really were kind enough you have teh 10 digit phone number on the Home page..CALL THEM and ask them why they banned u...It could be a mistake OR a genuine reason....
Call and find out...how do you know its coz of money...shame on you...so many of the 25K members have not paid a dime..so we should o nly have 5K odd members at that rate...So c'mon grow up and start calling lawmakers rather than sulking over stuff that has no meaning.

I am an Indian National residing in US for the past 10 years.
My labor was filed in September 2006 under Eb3. I received my EAD in 2007 and my current legal status is EAD. Since 2006, I am with the same employer.
In 2008, I got promoted to a Managerial position which requires Bachelors and
minimum 5 yrs progressive experience. I also have a Masters degree in the same field.
I want to port my application to EB2
1. Will this result in me loosing my EAD?
2. What will happen if there is a problem with the new EB2 application - will it also impact the EB3 application?
3. Is it better to change companies to do the porting?
Please advice.

1) With the soft quota, this leftover is given to the over subscribed countries in the SAME CATEGORY (Eb2). As a result, other EB2 candidates from India/China benefit
2) With the hard quota, this 10K now goes to UNSKILLED immigrants.
This amendment DOES NOT TAKE AWAY anything from the rest of the world at all! All it does is benefit SKILLED workers. Isn't IV about skilled workers? Why are some folks whose quota will NOT be CANNIBALIZED against this and consider this an issue of Indians/Chinese Vs Rest is beyond me. It is a matter of EB1 vs unskilled, EB2 vs unskilled and EB3 vs unskilled!

When is the last case for EB2 India approved?Just wanted to know the priority date of it.Mine is June 2006 EB2 when can i get my GC?Any guess?
This is wrong thread to ask that question, but anyway estimates are that 2006 Eb2s should be approved by 2013 considering the number of visas remain at 140K each year. Someone in IV made all this analysis and put an excel spreadsheet, you can find it in one of the forums and check yourself.

NSC is following FIFO. As per , NSC is adjudicating June 15 EAD filers as of the moment. So approximately, it will take 90 days from RNs for us to receive our EAD. However, this doesn't take into account surge in July filings. So, my best guess is, 90 to 120 days!

I became father last month.
My new born son is sick and he needs total attention for next 4 months. I have used up all my vacation and planning to apply for medical leave. Pediatrician recommends me getting medical leave and support my wife.
I work in a very big hardware company. I have completed 3.5yrs in H1B so far.f I apply for medical leave, I may get a pay cut (like 20 to 30%). Will I be affected because of this medical leave? Are H1B's allowed to take medical leave (upto 4 months)..

My priority date is June 2006.
I was with consulting company till 06/2009 after which I joined the client (fortune 10) company as full time employee. I'm on EB3 category using my EAD.
When I was with consulting company before I left they filed for my EB2 labor which is now approved.
Here is my DILEMMA.
OPTION#1) I can join my previous employer. i.e. the consulting company for interfiling between EB3 and EB2 so in which case if I go for premium I140 processing I will be on EB2 within a month or so.
BUT I'll have to leave my current full time employment which is with a fortune 10 company and good pay, I'm not comfortable to leave this position AND I do NOT want to loose the opportunity of getting my GC as soon as possible as EB2 dates are so close to my priority date.
OPTION#2) Discard the approved EB2 labor that my previous employer (consulting company) have for me and ask my current employer (fortune 10)company start my EB2 PERM labor and premium I140 and then interfile. IN THIS CASE, it might take about an year for me to get on to EB2 category BUT by then I'll miss the EB2 train if the dates become current before I get on to EB2 category....

I would not wait until April to be told by HR, Sorry we cannot do it or we will do it at our own pace. I mean, what is so difficult for HR or attorney to decide in filing your Perm? Do they need to do meetings about you everyday for 2 months to decide if they need to file for you?
Is that how corporates work? Imagine if you are given a project and you tell them to come back and talk after 2 months. Dude your end of H1B countdown has already started and you need to act even if you have a buffer time. I have also heard that if a company has layoffs, the company cannot do PERM for 6 months. So what if some layoffs happen until April? You maybe in a soup.
I suggest you take a hard look and do what is in your best interest. Put your own interest over all interest.

Same thing happened to mine. USCIS will pick up the packages from the USPS the next day so don't panic. Check for another status update tonight or Monday night, I'm 100% sure it'll say "delivered" then.

My wifes' application is in the same situation (though mine is clear). I sent (through attorney) proof of check encashment from the bank and also a new check for $70.
Attoney gave these options
1) Send ONLY proof of check encashment - This could lead to delay in Processing till they find the locate the missing check and account it
2) Send proof of check + $70 - They may or may not encash the new check. If they resolve the issue without encashing the new check, it's well and good. If they do encash it and the issue is resolved - well, it's still better than her application getting rejected over $70 [ Of course MTR and other actions can be taken, but didn't think it was worth it]
Attorney response has reached them. Waiting for the change in her application status ( God only knows when it'll get changed)
