I saw some of your suggestions in this thread. I need your suggestion on my case. I applied my 485 in July 2007 with an already approved eb3 I-140 (PD: May 2004). At that time, my 2nd EB2 I-140 was also in process but since I was not sure so I applied 485 with eb3 I-140. Later, I received my eb2 I -140 approved with the same PD of May 2004. Thus , I was able to capture my original PD (most difficult task!!). Since then, I and my lawyer have been sending letters to USCIS to interfile my eb2 140 with pending 485. We have not heard anything back from USCIS so far. I had opened congressional enquiry also and they also could not get answer from USCIS. But, congressman office told me that USCIS indicated that they will take most favorable 140 while adjudicating my case. They also suggested me to talk to them again when my pd is current based on eb2. Can u suggest as to what else can be done in this case? I appreciate your answer in this regard. I have my I-140 approved from previous employer , and my labor for the current employer is stuck at BEC center. Can i get a three year extension on my H1b ? OR the I-140 has to be from the current employer?

I somhow feel that Name Check problem has not been taken care of within its entirety. I agree with one thing that NC will be "improved" but has not been and will never be streamlined the way actually it should be.

My boss recently changed and the work environment is not good anymore (never imagined this would happen), I am in a constant pressure and no job security. It's a shocker in a fulltime state job.
We bought a house last year needless to say that the prices have fallen. We are now in a dazed state as we just realised we don't have any savings, whatever we had, we made bad choices - house, 2 cars (They looked good at that time though) and put about 10% on the house.
We were planning on to invest all our savings in the house as we recently paid off our two cars and no other debts. But after reading some posts here on the housing and investment market. I am not sure if I want to put everything in the house, having my job at risk and no GC yet.
Being a novice in fianancial matters, need advice.
Appreciate your thoughts on this.
Sorry to here the precarious condition you are living in. Try to be good to the person who is causing the pressure, cause most important of all right now is: You need the income. So, fighting with somebody is not a good idea and its going to hurt you, not the other person who is causing the pressure.
If the price of the house has fallen a lot, then its not a good idea to keep paying for the original price of the house. Talk to the bank, and ask what options you have.
Be prepared for the worst case scenario and start saving so that you have some buffer to make payments for at least 6 months, in case you lose your job.

I heard from my friends there are no legal implications if you get laid off on EAD and you also have a valid parolee document.
This should get verified from an attorney though, specially if others create a doubt.

Do not forget that the nurses / ph Therapist category swallows bunch of or all of EB3 visa numbers. This category is always current and they can make this EB3 to get stuck in April 22'01 for years.
Unfortunately most of the nurses also come from India I beleive. Some come south africa and phillipines. Do we have any data on this anywhere?
if 110,786 cases are due to retro...
then these cases are either (2nd China/India, 3rd, and other workers)??
considering 140,000 visa numbers available, and other catagories being current, only portions these retro cases will get visa numbers by this year..
no hope for PD advancement???

i would be happy if every one has same playing field.. i am a pharmacist and for pharmacist they need Pharm D to get license which is equivalent to Ph.d. in US and we are still in EB3 and i think every one will agree that demand of pharmacist is much more than any other field...

My wife is also in a similar situation. She went for stamping on Feb 1st and then she received a 221g yellow form. We submitted the docs and we are just waiting for a response for more than 3 months. I researched quite a bit on this one, but there is no way to expedite this process. I even contacted the local senator. This is happening quite a bit now. If the case is genuine then it will get approved, but it might take some time.

it seems democrats are making this bill so liberal that even liberal republican will have tough time to support it.... in that case democrats can say republican are not in favor of immigrants and Bush is not able to manage any support from his party.... The law finds an immigrant petion only when one applies via I130 (family based immigrant petition" or I140 (employment based immigrant petition). Only filing of IMMIGRANT PETITION would constituate a violation of one's non-immigrant intent and status.
